The Authority shall have the power <br /> to prohibit the discharge to the Joint Facilities of any <br /> substance in a concentration which exceeds the maximum <br /> limit that may have been established by resolution or <br /> ordinance of the Authority or of any Agency as necessary to <br /> safeguard the sewage treatment processes of the Authority or <br /> the Joint Facilities. The Authority shall cause the combined <br /> effluent of all Agencies to be monitored, as well as the <br /> receiving water of the combined discharge to determine whether <br /> federal and/or state discharge requirements are being met. <br /> In addition, the Authority shall cause the effluent of each <br /> Agency to be monitored. If the combined effluent of all <br /> Agencies at the point of ultimate discharge into the receiving <br /> water fails at any time to meet discharge requirements, the <br /> Agency or Agencies responsible for each violation shall be <br /> solely responsible for any fines levied or criminal sanc,tions <br /> imposed. In this regard, the Agency or Agencies responsible <br /> for any such violation shall hold harmless the Authority and the <br /> nonviolating Agencies from all liability and damages incurred by <br /> them or any of them as a direct and proximate result of such <br /> violation, including, but not limited to, legal, engineering <br /> and administrative expense, and direct or nondirect damages <br /> 3 <br />
