  _ N _ _ .
Recommendation:
1. Hold a Public Hearing on the Appeal by Save Pete's Harbor 2012 of
the Planning Commission approvals.
2. Continue the Public Hearing on the Appeal to a date certain in order
to afford the Applicant sufficient time to provide clarity regarding the State
Lands Commission's leases on the proposed use of the outer marina area.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY
DENYING APPEAL AND APPROVING A PLANNED DEVELOPMENT PERMIT
AND VESTING TENTATIVE MAP FOR THE PETE'S Ht4RBOR PROJECT
Mayor Aguirre reiterated that the public hearing will be continued to May 6, 2013 but
Council would hear public comment on just the continuance.
Public Comment
James Lee opined that whatever decisions are made all the 144 tenants, boaters,
"RVers," are a part of it and that they should be reached out to. He said he personally
feels the delay indicates that there are too many moving parts for it to be fast-tracked
and opined that he would have liked the appeal to be voted on tonight, but he
understands why it is being continued and hopes that in the future public input will taken
to heart.
Brett Garrett said he supports the tenants who live at Pete's Harbor and he opposes the
development in light of sea level rise. He requested that no one be evicted between
now and May.
Isak Lerner asked that the appeal, initial decision to approve this project and the
eviction of the tenants be delayed as the right thing to do because just delaying the
appeal would mean all the tenants would leave the harbor. He asked the city to help
delay everything.
Tal Raveh spoke in support of Isak Lerner's request to delay the appeal and the eviction
of people. She related how people were given notice to leave in November because the
marina would be shut down, but now she believes they were misinformed because the
water of the San Francisco Bay is under the jurisdiction of the State Lands Commission
and she asked for consideration for what happened as unjust and she said that it can be
corrected now.
Dr. Bell made some clarifying comments that the city has known that the land in
question was state land and that the city has no purview in regards to the transfer
between the state lands commission and the property owner. Council Member Foust
asked if there is anything in writing confirming that Save Pete's Harbor and the
developer wanted to postpone, and Dr. Bell said that there is an email from Ms. Madden
and the developer. Dr. Bell wanted to clarify for the record that it was the appellant and
the developer that requested the postponement of the project via email.
JOINT CITY COUNCIL/SUCCESSOR AGENCY BOARD January 28, 2013
MEETING MINUTES PAGE 9
MINUTE BOOK NO. 64
Page No. 269
