EXHIBIT B <br /> 6.3.B. - Page 9 g�gpLUTION NO. 2Q13 - 6934 <br /> RESOLUTION OF TIiE TOWN COUNCIL OF TF3E TOWN OF WOODSIDE: <br /> (1) CONSENTING TO THE ANNEXATION OF 135 DEAN ROAD (PROPERTY} SNT� THE <br /> TOWN CENTER SEWER ASSESSMENT DTSTRICT; {2) AUTiiORIZING THE TOWN <br /> MANAGER TO EXECUTE REVISED AGREEMENTS WITH REDWOOD CITX AND THE FAIR <br /> OAi[S SEWER MAINTENANCE DI3TRICT (FOSNID) TO ADD THIS PROPERTY INTO THE <br /> APPRQ't1ED SERVTCE ARE��, FOR THE TOWN CENTER SEWER ASSESSMENT DISTRICT <br /> (TCAD) AND TO REMOVE T�iE PROPERTY FROM THE REDWOOD CREEIC TRUNK SEWER <br /> ASSESSMEDiT DTSTRICT. <br /> WHEREAS, Section 51.123 of the Municipal Code has identified the <br /> Property w�thin Sewer Service Allocation Area II; anci <br /> WHEREAS, the Town Engineer finds that the septic system for the <br /> Property has failed as provided in Section 5�..122; and <br /> WHEREAS, Section 51.125{C) of the Municipal Code requires parcels <br /> that lie in "Area II" that have failed sept�c systems to connect to <br /> the public sewer system.; and <br /> WHEREAS, the owners af the Property hazre indicat�d connection �o <br /> sewer within the Redwood Creek Sewer Assessment District cannot be <br /> completed; and <br /> WfiEREAS, the owners of the Proper�y have applied far a sewer <br /> connection to '�CAD; and <br /> WHEREAS, the connection to T'CAD sewer facil.ities is consistent <br /> with the General Plan and reserved s�wer capacity in the TCA� is <br /> avaiiable; and . <br /> WSEREAS, the iegislative bodies of Redwood City and the Eair Oaks <br /> Sewer Nfaintenance District will need to agree �o amen.d the agreements <br /> that both those agencies have witl� the Town of Waodside pertaining ta <br /> the Tawn Center Sewer Assessment District in order to allow this <br /> property to be annexed into the District and the Town will need to <br /> execute amended agreements accardingly. <br /> L3E3W THEREFORE, IT IS HEREHY RESOLVED BY THE TOWN CQUNCIL OF THE <br /> TOWN OE WOODSIIIE THAT: <br /> 1. Th� Town. Council consents to the annexation of 135 Dean Raad <br /> into the Town Center Sewer Assessment District; and <br /> 2.
