6.1.G. - Page 3 <br /> LICENSE AGREEMENT BETWEEN THE CITY OF REDWOOD CITY <br /> AND <br /> SOUTH BAYSIDE SYSTEM AUTHORITY <br /> THIS LICENSE AGREEMENT ("Agreement") is entered into as of the <br /> , 2013 ("Effective Date"), by and between the CITY OF REDWOOD <br /> CITY, a charter city and municipal corporation of the State of California ("CITY"), and the <br /> SOUTH BAYSIDE SYSTEM AUTHORITY, a California public agency ("AUTHORITY"). <br /> RECITALS <br /> A. CITY owns real property commonly referred to as the Former Sewage <br /> Treatment Plant Site, located in the vicinity of the northeasterly terminus of Maple Street <br /> in Redwood City, California, as more particularly described in Exhibit "A" attached hereto <br /> and incorporated herein by reference ("City Property"). <br /> B. AUTHORITY has undertaken a project for the rehabilitation, restoration and <br /> replacement of an existing underground reinforced concrete pressurized sanitary <br /> sewerage transmission main that conveys sewage emanating from the West Bay Sanitary <br /> District and the City of Redwood City to a pump station in the City of San Carlos <br /> ("Authority's Project"). <br /> C. AUTHORITY's Project employs both open-cut trench and microtunneling <br /> construction techniques. <br /> D. During construction of Authority's Project, AUTHORITY desires to use one <br /> portion of the City Property for a contractor staging area and a second portion for a <br /> temporary public by-pass road to accommodate the temporary closure of a portion of <br /> Maple Street in the City of Redwood City necessitated by the construction of Authority's <br /> P roj ect. <br /> E. CITY is willing to license to AUTHORITY use of the City Property for the <br /> aforesaid purposes on the terms set forth herein. <br /> AGREEMENT <br /> NOW, THEREFORE, for valuable consideration, receipt of which is hereby <br /> acknowledged, the parties agree as follows: <br /> 1. Grant of License. Starting on August 1, 2013 (the "Commencement Date"), <br /> CITY confers to AUTHORITY a revocable, personal, non-exclusive and non-possessory <br /> privilege and license to enter upon and use the City Property for the limited purposes and <br /> subject to the terms, conditions and restrictions set forth below. This Agreement gives <br /> AUTHORITY a license only and notwithstanding anything to the contrary herein, this <br /> Agreement does not constitute a grant by CITY of any ownership, leasehold, easement <br /> or other property interest or estate whatsoever in the City Property or any portion thereof. <br /> ATTY/AGR/2013.061/SBSA LICENSE AGREEMENT <br /> REV: 07-10-13 VR <br /> Page 1 of 13 <br />
