6.1.G. - Page 11 <br /> C. Workers' Compensation and Employers' Liability. Workers' compensation <br /> policy written in accordance with the laws of the State of California that includes a <br /> waiver of subrogation in favor of the City. This policy shall include Employer's <br /> liability coverage with limits not less than $1,000,000 per occurrence. <br /> D. Other. <br /> 1) The minimum limits of insurance coverage required of AUTHORITY under <br /> this Agreement shall in no event limit the liability of AUTHORITY under this <br /> Agreement. AUTHORITY shall deliver to CITY evidence of the coverage <br /> required hereunder on or before the Effective Date, and delivery of such <br /> evidence shall be a prerequisite to and condition of AUTHORITY's right to use <br /> the City Property pursuant to this Agreement. <br /> 2) All insurance required above, shall provide the CITY 30 days written notice <br /> in the event of cancellation. <br /> 3) With regard to the Liability insurance required above, CITY its officers, <br /> agents, employees, volunteers, and contractors shall be named as an <br /> additional insured on an endorsement with completed operations and on-going <br /> operations coverage. An endorsement providing that this coverage is primary <br /> and non-contributory shall also be provided. <br /> 4) Prior to the Effective Date AUTHORITY shall deliver to CITY certificates of <br /> insurance and additional insured endorsements in a form satisfactory to CITY, <br /> evidencing the coverages required hereunder, together with a copy of <br /> AUTHORITY's pooled insurance coverage document upon CITY's request. <br /> 5) AUTHORITY's compliance with the provisions of this Section shall in no <br /> way relieve or decrease AUTHORITY's indemnification obligations under this <br /> Agreement or any of AUTHORITY's other obligations hereunder. <br /> Notwithstanding anything to the contrary in this Agreement, this Agreement <br /> shall terminate immediately, without notice to AUTHORITY, upon the lapse of <br /> any required insurance coverage. AUTHORITY shall be responsible, at its <br /> expense, for separately insuring AUTHORITY's personal property. <br /> 6) AUTHORITY may rely on a pooled or self-insurance program to meet the <br /> insurance requirements specified in this Section 16. <br /> 17. Entire Aqreement; Severabilitv. This Agreement contains the complete <br /> agreement between the parties relating to its subject matter. This Agreement may not be <br /> changed orally and may be amended only by an agreement in writing signed by both <br /> parties.
