6.1.G. - Page 19 <br /> a. Liability Insurance. Occurrence-based liability insurance covering <br /> third party bodily injury, personal injury, and property damage, including injury or <br /> damage arising out of pollution, with limits not less than $1,000,000 for each <br /> occurrence and $2,000,000 annual aggregate. <br /> b. Automobile Liability Insurance. Automobile liability insurance policy <br /> with a minimum limit of not less than $1,000,000 per accident. Coverage shall be <br /> applicable to all owned, hired or non-owned vehicles placed, parked or used by <br /> and under the control of Grantee or its contractor(s), subcontractors, consultants, <br /> employees, officers, agents and invitees This coverage shall be provided on an <br /> occurrence based form. <br /> c. Workers' Compensation and Employers' Liability. Workers' <br /> compensation policy written in accordance with the laws of the State of California <br /> that includes a waiver of subrogation in favor of the City of Redwood City. This <br /> policy shall include Employer's liability coverage with limits not less than <br /> $1,000,000 per occurrence. <br /> d. Other. <br /> (1) The minimum limits of insurance coverage required of Grantee <br /> under this Agreement shall in no event limit the liability of Grantee under this <br /> Agreement. Grantee shall deliver to Grantor evidence of the coverage required <br /> hereunder on or before the Effective Date. <br /> (2) All insurance required above, shall provide the Grantor 30 days <br /> written notice in the event of cancellation. <br /> (3) With regard to the Liability insurance required above, Grantor its <br /> officers, agents, employees, volunteers, and contractors shall be named as an <br /> additional insured on an endorsement with completed operations and on-going <br /> operations coverage. An endorsement providing that this coverage is primary <br /> and non-contributory shall also be provided. <br /> (4) Prior to performing any work or maintenance in the Easement <br /> Area, Grantee shall deliver to Grantor certificates of insurance and additional <br /> insured endorsements in a form satisfactory to Grantor, evidencing the <br /> coverages required hereunder, together with a copy of Grantee's pooled <br /> insurance coverage document upon Grantor's request. <br /> (5) Grantee's compliance with the provisions of this Section shall in <br /> no way relieve or decrease Grantee's indemnification obligations under this <br /> Agreement or any of Grantee's other obligations hereunder. Grantee shall be <br /> responsible, at its expense, for separately insuring Grantee's personal property. <br /> (6) Grantee may rely on a pooled or self-insurance program to meet <br /> the insurance requirements specified in this Section 4. <br /> 5. No Merqer; Recordation; Amendment. The Easement and rights <br /> granted hereunder shall not be terminated or extinguished by nonuse, <br /> abandonment or merger. This Agreement shall be submitted for recordation in <br /> the Official Records of San Mateo County, California.
