r , <br /> Section 30.63 of said Code is hereby granted for the above <br /> described real property to allow all of the proposed lots <br /> of the subdivision, except Lot A, to have less than 50 feet <br /> of street frontage, to have less than 90 feet of lot depth, and <br /> to have less than 6,000 square feet of lot area. <br /> 2 . The exceptions set forth in paragraph 1 hereof are <br /> granted subject to the following conditions relating to Peti- <br /> tioner' s request for a subdivision of the above described real <br /> property heretofore conditionally approved by the Planning <br /> Commission: <br /> a. That a Homeowners ' Association be organized for <br /> maintenance and operation of the common areas, <br /> structures, and facilities, including the exterior <br /> portions of the existing structure. As a condition <br /> of purchase of each unit of the condominium develop- <br /> ment, each owner shall be required to be a member <br /> of the Homeowners' Association, shall be assessed a <br /> sufficient sum to addquately provide for the <br /> maintenance and operation of the aforementioned <br /> common areas, structures and facilities, and shall <br /> have any assessment of the Association placed as <br /> a lien against his property if not paid. <br /> b. That an improvement agreement be entered into between <br /> the subdivider and the City to assure the construc- <br /> tion of the following improvements: <br /> (1) Installation of street monuments. <br /> (2) Replacement and/or reconstruction of <br /> existing curb. <br /> * * * <br /> -2- <br />
