F. Develoner Public Benefit Contribution for Depot Circle Imarovements <br /> , A portion of the Site lies adjacent to the Caltrain Station and pzoperty owned by <br /> the City. The City is in the process of planning for the development of its property, which is <br /> proposed to be a significant unifying urban landmark that will transfornn the area into a focal <br /> point and create a grand and welcoming entrance to the City for train passengers. Developer shall <br /> contribute $1,000,000 for development and installation of an iconic structure, public plaza or <br /> other civic use to be determined by City in its sole discretion, although City agrees to consult <br /> Developer and the developer of the Winslow Lot regarding the design and nature of the public <br /> improvements to be developed. <br /> G. Electronic SiQn <br /> As part of the Project, the parties may agree that the Project shall include an <br /> electronic sign on the Site in the event the City Council amends its existing sign ordinance to <br /> ' allow such a sign. The parties intend that the sign would be used by the City for up to twenty <br /> percent(20%) of the sign's operational time to provide government-related and/or public service <br /> ' messages. The ternns and conditions regarding the installation and use of the sign would be <br /> reflected in an amendment to the DDA. <br /> II. OBLIGATIONS OF THE CITY <br /> A. Culvert Relocation <br /> Prior to the close of escrow on the conveyance of the City Property to Developer, <br /> City, at its sole cost, shall be responsible for relocating the box culvert and utilities(if any) <br /> currently located on the City Property, in accordance with the plans and specif'ications entitled <br /> "Crossing 900," dated April 26, 2012.
