15. insurance. During the term of this Agreement, LICENSEE shall maintain the following <br /> insurance coverage: <br /> A. Liabilitv Jnsurance Occurrence-based liability insurance covering third party bodily <br /> ' injury, personal injury, and property damage, including injury or damage arising out of <br /> pollution, , with limits not less than $1,000,000 for each occurrence and $2,000,000 <br /> annual aggregate. <br /> B. Automobile Liability Insurance. Automobile liability insurance policy with a minimum <br /> limit of not less than $1,00O,OOU per accident. Coverage shall be applicable to all owned, <br /> hired or non-owned vehicles placed, parked or used by and under the control of <br /> ' LICENSEE or its contractor(s), subcontractors, consultants, employees, officers, agents <br /> and invitees This coverage shall be provided on an occurrence based form. <br /> C. Workers' Comnensation and Emqlovers' Liabilitv. Workers' compensation policy <br /> written in accordance with the laws of the State of California that includes a waiver of <br /> subrogation in favor of the City. This policy shall include Employer's liabilit�r coverage <br /> with limits not less than$1,000,000 per occurrence. <br /> D. Other. <br /> 1) The minimum limits of insurance coverage required of LICENSEE under this <br /> Agreement shall in no event limit the liability of LICENSEE under this Agreement. <br /> ' LICENSEE shall deliver to CITY evidence of the coverage required hereunder on or <br /> before the Effective Date, and delivery of such evidence shall be a prerequisite to <br /> ; and condition of LICENSEE's right to use the City Property pursuant to this <br /> ' Agreement. <br /> 2) All insurance required above, shall provide the CITY 30 days written notice in the <br /> ' event of cancellation. <br /> 3) With regard to the Liability insurance required above, excepting any pollution <br /> ' legal liability policy, CITY, its officers, agents, employees, volunteers, and <br /> ' contractors shall be named as an additional insured on an endorsement with <br /> completed operations and on-going operations coverage. An endorsement <br /> ' providing that this coverage is primary and non-contributory shall also be provided. <br /> , 4) Prior to the Effective Date LICENSEE shall deliver to CITY certificates of <br /> ' insurance and additional insured endorsements in a form reasonably satisfactory to <br /> CITY, evidencing the coverages required hereunder. <br /> 5) LICENSEE 's compliance with the provisions of this Section shall in no way <br /> relieve or decrease LICENSEE 's indemnification obligations under this Agreement <br /> or any of LICENSEE 's other obligations hereunder. Notwithstanding anything to the <br /> contrary in this Agreement, this Agreement shall terminate immediately, without <br /> notice to LICENSEE, upon the lapse of any required insurance coverage. <br /> LICENSEE shall be responsible, at its expense, for separately insuring LICENSEE`s <br /> personal property. <br /> 7 <br /> 2013.118/BLOCK 2 HUNTER STORM <br /> REV:07-26-13 PT <br />
