EXHIBIT"D" <br /> TO <br /> DISP�SITION AND DEVELOPMENT AGREEMENT <br /> PERFORMANCE SC�IEDULE <br /> A. Days shall be calendar days, unless otherwise speci�ed. <br /> B. The City Manager is authorized by the City to make minor changes to the <br /> schedule prior to the Project Completion Date resulting in an aggregate extension of the Project <br /> Completion Date of one hundred twenty(120) calendar days or less. <br /> C. In the event of any conflict between this Schedule and the Agreement, the terms <br /> and provisions of the Agreement shall control. <br /> : D. All defined terms indicated by initial capitalization used in this scheriule shall <br /> ; have the meanings ascribed to the same terms in the Agreement. <br /> E. Tn the event City disapproves any of Developer's required submissions, it shall <br /> specify the reasons in writing for its disapproval and the Performance Schedule shall be extended <br /> in accordance with the time required for the Developer to revise and resubmit such plans (as <br /> applicable) and for the City to render a decision on Developer's resubmission. <br /> ACTION DATE <br /> 1. Execution and Deliverv of Agreement by Seven (7) days prior to City Council <br /> Developer. The Developer shall execute consideration of the DDA and Project. <br /> and deliver this Agreement to the City. <br /> ' 2. Execution of Agxeement by City. The Within 14 days after City Council approval. <br /> City Council shall hold a public hearing <br /> to authorize execution of this Agreement <br /> by the City, and if so authorized,the City <br /> : shall execute and deliver this Agreement <br /> to the Developer. <br /> 3.
