------- -- , - - -- ---- --------- - - n - -- -- -~--
In response to Directors questions, Mr. Adams advised the Schiavones
have the right to claim for loss of rents during the trial.
Mr. Church advised that when tenants move the Agency pays the rent and
keeps the spaces vacant.
The Board discussed the appropriateness of a continuance for the owners
who requested them.
Mr. Phillips, representing the Cooks, readdressed the Board, and
advised that the relationship he had with Mr. Michaels was favorable,
and that Mr. Michaels told him the Cooks would have to at least the end
of October to relocate. Mr. Phillips also addressed the issue of three
properties needing remediation not being addressed tonight and asked if
they could be joined together.
Director Murray advised that owners do not have to go to court tomorrow
to defend themselves, that the purpose of this hearing was to determine
whether the Board wants to acquire these lands and deposit the earnest
money in court to go forward. Director Murray stated a continuance
would not change anything, and the best thing to happen for these
owners would be to end the uncertainty and get money deposited in
court, and delaying the procedure would be a harm to the owners.
Discussion ensued regarding a date and time for a continued public
hearing.
MIS: ClAIRE/BURY TO CONTINUE THE OPEN HEARING CONCERNING THE
PROPERTIES AT 29 TO 31 JAMES AVENUE (ROBERT AND JANICE COOK) AND 1025
El CAMINO REAL (lOUIS AND SANDRA SCHIAVONE) TO 12:00 NOON, JUNE 9TH IN
THE CITY HALL CONFERENCE ROOM.
THE MOTION CARRIED ON THE FOLLOWING ROLL CALL VOTE:
AYES: DIRECTORS BUCHAN, BURY, CLAIRE AND CHAIRWOMAN LA BERGE
NOES: DIRECTORS GREENAlCH, MURRAY AND STANGEL
MINUTE ORDER NO.
