<br /> - -- - --- --~--- - - ------ - -- - ---- <br /> Mr. Hildebrand advised that these issues are not before the Council <br /> tonight, and the attorney for Mr. Davies is looking at the possible <br /> abandonment of Franklin Street at a later stage of the Redevelopment <br /> process and at that time the City Council has the authority to <br /> abandon public streets and easements and the issue of whether it is <br /> appropriate to abandon Franklin Street can be decided then. At this <br /> time only the acquisition of the underlying fee is before the Board. <br /> 5. Mr. Davies contends he has a valuable lease with the Chevrolet <br /> dealership which will be damaged if this property is condemned. <br /> Mr. Hildebrand advised that tonight's Hearing is not the forum to <br /> determine this issue, but it may be raised later in court. <br /> 6. Mr. Davies protests the City's designation of the present use of the <br /> property as "vacant land." The property is used for parking <br /> vehicles and other related uses of the Chevrolet dealership. <br /> Mr. Hildebrand advised the Agency contends that the claimed use is <br /> not a legally approved use. The use exists across a public street <br /> from the dealership, but has never been given City approval, no <br /> application for use permit has been made. The Agency is discussing <br /> with the owner of the dealership the possible relocation of the <br /> parking of the vehicles now being made legally or illegally on that <br /> property. <br /> 7. Mr. Davies does not agree that Franklin Street should be condemned <br /> andlor that its use should be taken from the general public. <br /> Mr. Hildebrand advised that this issue had been dealt with, it is <br /> the same version of the issue of the abandonment of Franklin Street, <br /> and this is not a hearing for abandonment. <br /> 8. From the inception of the redevelopment concept, Mr. Davies has been <br /> advised that the Davies property would not be included in any <br /> redevelopment project. This present request seems contrary to that <br /> advice. <br /> Mr. Hildebrand advised that staff believes that originally and <br /> through December 1989, the dealership, the corner parcel on <br /> Jefferson and El Camino Real, was not even in the Redevelopment <br /> Project area and therefore the Redevelopment Agency had no power to <br /> deal with that corner parcel, and Mr. Davies may have been advised <br /> that that corner parcel was not going to be included in the Project. <br /> It still is not included in the current Project at this time, but <br /> the Project area was expanded in December 1989 and does embrace the <br /> dealership corner parcel as well, but that issue is not before the <br /> Board tonight.
