Mr. Phillips <br /> requested that the Board give the Cooks until that date. <br /> In response to questions from the Board, Mr. Cook explained that his <br /> clientele has monthly requirements, and his trophy business is least busy <br /> during October, and that being down for any period of time is a tremendous <br /> imposition. Mr. Cook stated he has so much work from now until September <br /> 15th that he just cannot take the time to do what is necessary to relocate. <br /> Chairwoman la Berge called upon Mr. Schiavone to address the Board. <br /> Mr. Schiavone restated that he had problems with the Redevelopment Agency's <br /> agent, Mr. Michaels and the contacts were unproductive; Mr. Michaels made <br /> one offer, and Mr. Schiavone made one counter, and Mr. Michaels did not <br /> contact him again; and the Redevelopment Agency acquisition and relocation <br /> documents distributed earlier should advise property owners to get an <br /> attorney. <br /> Mr. Adams advised that under the law the Agency must obtain an <br /> appraisal based on fair market value before they make the offer, which <br /> means the highest price, in terms of what that property would sell for at <br /> the time of the offer. Under the law the highest price is the point where <br /> the Agency begins negotiations. The Agency hired Frank Fabro to do the <br /> appraisal and based on his appraisal the offer was made to the Schiavones. <br /> There was nothing else Mr. Michaels could do at that point based on Mr. <br /> Fabro's appraisal and the fact that Mr. Schiavone had not yet obtained an <br /> appraisal of his own. The Agency begins negotiations at the fair market <br /> value and cannot make a gift of public funds. <br /> In response to questions from the Board Mr. Schiavone stated he did not <br /> want to sell his property, that the building should be saved because of its <br /> history, its architecture and its uniqueness, but he had been told by Mr. <br /> Church that it had no historical significance.
