A copy of the Agreement is on frle witI� the City Clerk and is available for <br /> inspection and capying by interested persons as a public record of the City during the regular <br /> business hours of the City. <br /> The Ageernent affects the real property(the "Site") described in Exhibit"A" attached to <br /> this Notice of Agreement. The meaning of defined terms used in this Notice of Agree�aent sha11 <br /> be tk�e same as set forth in the Agreern.ent. <br /> Section 1. PLEASE TAKE FURTHER NOTICE that the Agreement cantaans certain <br /> covenants running with the land and other agreements between the DeveZoper and the City <br /> affecting the Site, including, without limitation, (all section references are to the Agreement}: <br /> "5.1 No Conveyance to Tax Exeinpt Entity. <br /> 5.1.1 Covenant. The Developer covenants and agrees that during the Covenant <br /> Period, neither the Developer, nor its successors or assigns shall Transfer all or <br /> any portion of the Site or the Project to any Person or use a11 or any portion of the <br /> Site or the Project for any use, that is partially or wholly exempt froin the <br /> payment of property t�es or that would cause the exemption of the payment of <br /> all or any portion of property taxes otherwise assessable regarding the Site or the <br /> Project,without the prior written consent of the City,prior to the expiration of the <br /> Covenant Period. <br /> Exhibit"F" <br /> Form OfNotice OfAgeement <br /> .
