City Draft <br /> 6128/13 <br /> obligarion with respect to alternatives to the loss of public parldng currently located on the Site <br /> during the Construction Period. <br /> 4.b.3 Priar ta comnaencement of construction of the Project, Developer shall <br /> deliver, or cause Developer's Contractor to deliver, to the City copies of payment bond(s) and <br /> performance bond{s) issued by a reputable bonding company licensed to do business in <br /> Calzfornia, and reasonably acceptable to the City, providing for payment and pe�rformance bonds <br /> for one hundred percent (100%) of the scheduled work of construction of the Project, including <br /> labor, material and equipment used in the work of improveznent of the individual constructian <br /> trade element of the Project, and for the Contractor's timely completion of the work of <br /> improvement of the individual construction trade element of the Project. Each such bond shall <br /> be in a penal sum of not less t�an one hundred percent (100%) of the scheduled cost of <br /> construction of the Project. The bond.s shali name the City as joint obligee. Developer sha11 <br /> also provide, or cause Developer's Contractor to provide, a public improvement bond far the <br /> performance of work with respect to any public improvernents constructed as part of the Project. <br /> The City ag�rees that to the extent that any work covered by the Construction Contract constitutes <br /> public improvements which the City requires be separately bonc�ed pu.rsuant to the preceding <br /> sentence, then the penal amount of the payment and performance bond(s) provided. pursuant to <br /> the first sentence of this paragraph may be reduced by the penal amount of any such separate <br /> bond(s) so that the same public improveme�rrt work is not bonded twice. <br /> 4.6.4 During the period of construcrioz�, the Developer shalf provide to the <br /> City's Project Manager, an a monthly basis, an updated Critical Path Management Schedule, <br /> inclu�ing a tk�ree-week project iook-ahead schedule. The Critical Path Managernent Schedule <br /> shall be in such form and detail as may reasonably be required by the City. <br /> 4.6.5 Where the overall construction schedule will be reduced or duration or <br /> severity of impact to other businesses ar traffic circulation could be reduced by canstruction <br /> prior to 7:00 a.m. or after 8:00 p.m., construction will be permitted outside of norma� <br /> construction hours with 24-hour advance written notice provided to the City's Building O�icial. <br /> 4.6.b City agrees to allow Developer access to an ad�acent City-owned lot, <br /> located to the west of the Site, between Winslow Street and Hamilton Street (referred to as the <br /> "Winslow Lot"} for purposes of staging activities related to the construction of the Project on the <br /> Site. Any such access and use of the Winslow Lot shall be conditioned upon and subject ta an <br /> entry and access agxeement or other similar agreement to be entered into between the City and <br /> Developer prior to any such access and use, substantzally in the form attached hereto as Exhibit <br /> J(Forrn of License Agreement for Winslow Lot} and incorporated herein by reference. <br /> 4.6.7 On or before the Project Completion Date, the Developer shall: <br /> (a) Complete the Project and obtain and record a Notice of <br /> Completion, in accordance with California Civil Code Section 8182, for the Project; <br /> (b) Cause the Project to be inspected by each Government Agency <br /> az�d correct any defects and deficiencies that may be disclosed by any such inspection; <br /> 82483.00 00 9175 7 1 3 1 2.10 31 <br />
