City Draft <br /> 6128/13 <br /> EXHIBIT "D" <br /> TO <br /> SPOSITION AND DEVELOPMENT AGREEMENT <br /> PERF4RMANCE SCHEDULE <br /> A. Days shall be calendar days,unless otherwise speci�ed. <br /> B. The City Manager is authorized by the City to make minor changes to the <br /> schedule prior to the Project Completion Date resulting in an aggregate extension of the Project <br /> Cornpletion Date of one hundred twenty(120) calendax days or less. <br /> C. In the event of any conflict between this Schedule and the Agreernent, �the terms <br /> and provisions of the Agreement shall control. <br /> D. All de�ned terms indicated by initial capitalization used in this schedule sha11 <br /> hava tlie rneanings ascribed to the same terms in the Agreement. <br /> E. In the event City disapproves any of Developet's reyuired submissions, it shall <br /> specify the reasons in writing for its disapproval and the Ferformance Schedule shall be extended <br /> in accardance with the time required for the Developer to revise and resubmit such plans (as <br /> applicable} and far the City to render a decision on De�eloper's resubmission. <br /> ACTION DATE <br /> �. Execution and Deliyery of Agreement by Seven (7) days prior to City Council <br /> Developer. The Developer shall execute consideration of the DDA and Projact. <br /> and deliver this Agreement to the City. <br /> 2. Execution of A�reement bv Citv. The Witivn 14 days after City Council appraval. <br /> City Council shall hold a public hearing <br /> to authorize execution of this Agreement <br /> by the City, and if so autharized, the City <br /> shaZl execute and deliver tl�is Agreement <br /> to the Developex. <br /> 3. D_eposit. The Developer shall deliver the Prior to or simultaneously with execution of <br /> Depasit to the City. this Agreement by the City. <br /> 4. Openin� of Escrow.
