6.1.F. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> August 26, 2013 <br /> SUBJECT <br /> Maintenance Agreement for 3718 Laurel Way <br /> RECOMMENDATION <br /> By motion, approve and authorize the City Manager to execute a Maintenance <br /> Agreement with Cornelius Brosnon et al. and authorize the City Clerk to record the <br /> Maintenance Agreement upon full execution thereof. <br /> BACKGROUND <br /> On April 4, 2012, the City's Zoning Administrator approved the Planned Development <br /> Permit (PD2011-04) for 3718 Laurel Way. The project consists of a new single-family <br /> residence on an existing vacant lot. <br /> ANALYSIS <br /> Improvements associated with this project include reconstruction and widening of the <br /> existing roadway, and installation of new curb and gutter. The improvement plans <br /> comply with City ordinances, City standards, and are prepared to the satisfaction of the <br /> City Engineer. The cost of constructing the improvements is the developer's <br /> responsibility. Condition No. 27 of the Notice of Official Action dated April 4, 2012, <br /> requires the developer to enter into a Maintenance Agreement. By this proposed <br /> agreement, the cost of maintaining the roadway, curb and gutter in the future becomes <br /> the responsibility of the developer or his successors and assignees. <br /> ALTERNATIVES <br /> Council may choose not to approve the maintenance agreement for the project. <br /> FISCAL IMPACT <br /> There is no fiscal impact to the City as a result of this action. <br /> ENVIRONMENTAL REVIEW <br /> The Zoning Administrator made the finding that the project is considered categorically <br /> exempt from the requirements of the California Environmental Quality Act pursuant to <br /> Section 15303 Class 3, which exempts new construction or conversion of small <br /> structures. More specifically, Subsection 15303(a) of the CEQA guidelines allows for <br /> the exemption of one single-family residence, or up to three single-family residences in <br /> urbanized areas. <br />
