APPROVED BY UNANIMOUS ROLL CAll VOTE. <br /> L ---------------------------------------------------------------------------- <br /> B. Report detailing the Trestine Project options: residential project, <br /> commercial project, financing, and extension of the ERN; (1402-04) <br /> REPORT: Redevelopment Agency Executive Director, September 27, 1993 <br /> Director Church presented the staff report and explained the Agency's <br /> recommendations regarding both the commercial and residential projects, <br /> Items 1. a. and b., and 2. a. through e. of the staff report. Item 2. <br /> e. states: "That the ERN contain language acknowledging that both <br /> parties are proceeding forward with this project at their own risk and <br /> waiving any disputes that predate this ERN extension. If the developer <br /> will not agree to such language, staff recommends that the ERN extension <br /> NOT be granted." <br /> In response to Directors' questions, Agency Attorney Schricker advised <br /> that no legal disputes have been identified, nor are there any actions <br /> pending. Mr. Schricker added that only a majority vote of the Agency <br /> Board can authorize actions on behalf of the Redevelopment Agency, and <br /> staff members or individual Agency Directors have no authority to commit <br /> the Redevelopment Agency to any action whatsoever. <br /> Director Church provided background on the subject property, Opportunity <br /> Areas 9 and 10, and the Agency's commitment to affordable housing. <br /> --- <br /> The Directors discussed impact of the proposed projects on the Canned <br /> Food Store, the downtown area and the Agency's budget. The Directors <br /> asked that staff provide the entire Agency budget at a future meeting, <br /> including all the proposed projects and their ~conomic impacts. <br /> MEMO 9/29/93 <br /> MIS: GASPARINIIGREENALCH TO ACCEPT STAFF'S RECOMMENDATIONS <br /> Chairwoman Buchan called on the following people to speak to the motion: <br /> Patrick Edens, SecretarYITreasurer of Trestine, advised that the <br /> language for the extension of the ERN is not acceptable as it changes the <br /> process and proposes to wipe the slate clean and start over.
