Report detailing the Trestine Project options: residential project, commercial project, financing, and extension of the ERN; (1402-04) REPORT: Redevelopment Agency Executive Director, September 27, 1993 Director Church presented the staff report and explained the Agency's recommendations regarding both the commercial and residential projects, Items 1. a. and b., and 2. a. through e. of the staff report. Item 2. e. states: "That the ERN contain language acknowledging that both parties are proceeding forward with this project at their own risk and waiving any disputes that predate this ERN extension. If the developer will not agree to such language, staff recommends that the ERN extension NOT be granted." In response to Directors' questions, Agency Attorney Schricker advised that no legal disputes have been identified, nor are there any actions pending. Mr. Schricker added that only a majority vote of the Agency Board can authorize actions on behalf of the Redevelopment Agency, and staff members or individual Agency Directors have no authority to commit the Redevelopment Agency to any action whatsoever. Director Church provided background on the subject property, Opportunity Areas 9 and 10, and the Agency's commitment to affordable housing. --- The Directors discussed impact of the proposed projects on the Canned Food Store, the downtown area and the Agency's budget. The Directors asked that staff provide the entire Agency budget at a future meeting, including all the proposed projects and their ~conomic impacts. MEMO 9/29/93 MIS: GASPARINIIGREENALCH TO ACCEPT STAFF'S RECOMMENDATIONS Chairwoman Buchan called on the following people to speak to the motion: Patrick Edens, SecretarYITreasurer of Trestine, advised that the language for the extension of the ERN is not acceptable as it changes the process and proposes to wipe the slate clean and start over. Mr. Edens suggested that the ERN should be extended as is, and discussions regarding disputes should take place when the DDA is being negotiated. The Directors discussed the future of the Canned Food Store and Canned Food site, relocation realities, final approval of the ERN and the risks normally taken by developers.
