Disposition and Development Agreement (DDA) for Wyndham Place Project
(1402-04)
REPORT: Redevelopment Agency Executive Director, January 10, 1994
Director Church presented the staff report.
Councilman Greenalch thanked staff for the well-done and professional
DDA. Councilman Greenalch noted that the reference on Page 7, Section
209, Form of Grant Deed, to Section 211 should in fact reference Section
210, and on Page 15, Section 217 D, Project Site Remediation a completion
date of February 1, 1994 is cited. Housing Specialist Svoboda advised he
would revise the DDA to correct the reference to Section 211.
In response to questions from Redevelopment Agency Attorney Hildebrand,
project principals Bill Butler, President of W. L. Butler Construction,
and Scott Steitler, Principal with Stellar Homes, agreed to accept the
County's remediation efforts as sufficient and use March 1, 1994 as the
completion date in the DDA.
Councilman Greenalch directed attention to Pages 29 and 30, Section 602,
Nondiscrimination and asked that the DDA add nondiscrimination based on
handicapped or disabilities and sexual preference which is the official
policy of the City.
In answer to Directors' questions City Attorney Schricker advised that
although these matters are covered under the Fair Housing and Equal
opportunity Acts they are also matters of contract, and nondiscrimination
clauses based on sexual preference and disabilities could be included in
the language of the DDA.
Mr. Butler and Mr. Steitler had no objection.
Attorney Hildebrand advised the wording for the nondiscrimination clause
came directly out of the State Health and Safety Code.
In answer to Director's questions regarding the quoted prices of the
units on Pages 5 and 6 of the proposed DDA, Mr. Svoboda described the
compensation to the builder and the City's cost per unit, and the cost to
Special Redevelopment Agency Agenda
January 10, 1994
Page 2
MINUTE BOOK NO.1
Page No. 157
