09/09/2013 ORIGINAL ORDINANCE NO. 2397 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AMENDING ORDINANCE NO. 2376 BY MODIFYING THE BOUNDARIES OF THE ESTABLISHED MIDDLEFIELD ROAD UNDERGROUND UTILITY DISTRICT NO. 2011-1 TO INCLUDE ADDITIONAL TERRITORY AND EXCLUDE OTHER TERRITORY AND BY EXTENDING THE REMOVAL DATE FOR OVERHEAD UTILITIES WHEREAS, on February 6, 2012, the City of Redwood City adopted Ordinance No. 2376 establishing the Middlefield Road Underground Utility District No. 2011-1 to remove existing overhead utility lines and other appurtenances and place said utility lines and other appurten�nces underground on Middlefield Road between Main Street and MacArthur Avenue; and WHEREAS, Redwood City now proposes to modify the boundaries of the MUUD to exclude certain territory and include additional territory and to extend the removal date for all overhead facilities within the district one year to provide more construction time for the project; and WHEREAS, the Community Development Department for the City of Redwood City has consulted with the affected public utilities and such utilities have agreed that additional territory should be included and other territory excluded from the established Middlefield Road Underground Utility District No. 2011-1, as more particularly described in Amended Exhibit "A" (legal description) and Amended Exhibit "B" (boundary map) attached hereto and incorporated herein by reference; and WHEREAS, the City Council has now received the report from the Community Development Director recommending that the boundaries of the established Middlefield Road Underground Utility District No. 2011-1 should be modified to include additional territory and exclude other territory, as identified in Amended Exhibits "A" and "B" hereto; and WHEREAS, the proposed boundary modification of Middlefield Road Underground Utility District No. 2011-1 is categorically exempt from environmental review pursuant to the California Environmental Quality Act; and WHEREAS, pursuant to the provisions of Article II of Chapter 11 of the Code of the City of Redwood City (commencing with §11.30), proceedings for the modification of the boundaries of the Middlefield Road Underground Utility District No. 2011-1 were instituted by Resolution No. 15285, adopted July 22, 2013; and ATTY/ORD.392/MIDDLEFIELD UUD DISTRICT AMENDMENT ORD.#2397 REV:08/16/13 VR Formerly MUFF#804
