8.A. - Page 4 <br />It is true that a future lot owner could apply to amend the PD to allow for larger home <br />sizes than what the Planning Commission approved. The determination of additional <br />environmental review would depend on the specific application. However, that possible <br />future action does not constitute a basis for rejecting the Planning Commission's <br />actions. Any future such amendment inconsistent with the Planning Commission's <br />actions would require review and approval by the Commission at a noticed public <br />hearing, and would be subject to appeal to the City Council. <br />For all of the foregoing reasons, staff recommends rejecting SLW's appeal. <br />Applicant's Appeal <br />The applicant's appeal only challenges Condition No. 19 of the Planning Commission's <br />action. This condition restricts the house sizes to smaller than what the applicant <br />proposed (Attachment 5). In 2007, the Planned Development permit requested home <br />sizes ranging from 3,240 to 5,120 buildable square feet, with an average of 3,965 <br />square feet. With the submittal of the 2011 application, the applicant proposed home <br />sizes ranging from 3,300 to 4,500 buildable square feet, with an average of 3,809 <br />square feet. City staff originally drafted Condition No. 19 to reflect the applicant's <br />proposal. However, in acting upon the project, the Planning Commission amended <br />Condition No. 19, adopting a formula, reflected in Alternative B of the RFEIR, to <br />calculate the allowable home size based on the current lot size and average slope (with <br />the minimum livable space of 2,000 square feet). Table 1, as referenced below, <br />provides the potential home sizes based on the approved formula. As a result, based <br />on current property data this reduced the allowable home sizes. Property owners were <br />guaranteed a home size of at least 2,000 square feet of livable space, which when <br />incorporating a standard garage is approximately 2,400 square feet. The resulting range <br />of home sizes per Condition No. 19 is 2,000 to 3,432 square feet with an average of <br />2,638 square feet. <br />Page 4 of 12 <br />
