,i 8.A. - Page 113 <br />RIEIPIOIRIT <br />September 1. 1988 <br />EXTENSION OF DEVELOPMENT ON LAUREL WAY <br />TO THE NONORAL <br />AWOR AND GA'r •OOUNM <br />vRW TO CifT MAKOAM <br />INFORMATION ONLY <br />This -is an information report to recap the history of this subject, inform the <br />Council about recent applications for building permits and staff's intended <br />actions. <br />Background and Discussion: <br />In, 1970 the City unsuccessfully attempted to have public improvements in <br />Laurel Way installed under an assessment district. (The chronology of the <br />district is in Appendix "A"). Flans and specifications were prepared and a <br />soil and geologic investigation undertaken. They are -available as input to an <br />environmental impact. report considered necessary by the staff, subject to <br />revisions of the construction documents to current materials and. construction <br />standards. The soil and geologic investigation must be upda'ted to provide <br />design and quality control for future development. Staff continues to have <br />major concerns about geologic conditions in this area which may expose people <br />or structures to geologic hazards. <br />in addition, the plans and specifications prepared in 1970 do not conform to <br />current ordinances, specifically the street width. This leaves two options: <br />Option 1: Amend the pertinent Ordinance to permit the non -conforming <br />street width. In such case, the Laurel Nay right-of-way which <br />was offered for dedication and not accepted on the Subdivision <br />Map, could be accepted by, the .City, or <br />Option 2: Cdndition any further development subject to all owners <br />adjacent to the existing unimproved private street" -o enter <br />into all' dgreement to maintain the street. <br />It should be understood that a decision to allow development to proceed on <br />Laurel Way will almost certainly require that variances be given for the <br />construction of each dwelling. The lots are so steep that we can expect that <br />there will be substandard setbacks from the street and building heights <br />exceeding the 30 -foot height limit. In addition, there may be a substantial <br />loss of mature trees and a significant amount of grading. <br />A prior staff report explaining the development problems is in Appendix "B". <br />Since that report, the Hatfields have built A house, and provided water and <br />sewer line extensions under a special improvement agreement with the City. <br />This Agreement also required construction of road improvements for one-half of <br />the street width, and specified that the streets shall remain private unless <br />later improved'to its full width under assessment or other proceedings.
