7.1.D. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />September 23, 2013 <br />SUBJECT <br />Amendment No. 1 to the Professional Services Agreement with Moore lacofano <br />Goltsman Inc. (MIG) for professional environmental planning services related to the <br />Pete's Harbor project. <br />RECOMMENDATION <br />By motion, approve, and authorize City Manager to execute, Amendment No. 1 to the <br />Professional Services Agreement with MIG in the amount of $37,542 to provide <br />professional environmental planning services, including the preparation of an <br />Addendum to the previously certified Final Environmental Impact Report, for the Pete's <br />Harbor project, resulting in a total Agreement amount of $95,847. <br />BACKGROUND <br />On September 25, 2012, the original agreement was executed with Moore lacofano <br />Goltsman, Inc. (MIG) for professional environmental planning services to provide project <br />environmental review, documentation, and public outreach associated with the <br />environmental review for the Pete's Harbor project. The initial contract amount was <br />$58,305. <br />ANALYSIS <br />Amendment No. 1 in the amount of $37,542 provides ongoing professional <br />environmental planning services due to the extended review and processing of the <br />proposed project pursuant to an appeal to the City Council, remand back to the <br />Planning Commission, modification to project design and scope by the Applicant, and <br />unforeseen ownership and lease disputes. MIG is specifically preparing an Addendum <br />to the certified Final Environmental Impact Report for the Marina Shores Village Project <br />(June, 2003). <br />The overall contract amount, including this amendment, will total $95,847. <br />ALTERNATIVES <br />Council may choose not to approve the proposed amendment. <br />FISCAL IMPACT <br />The Pete's Harbor project is a cost recovery project, with the Applicant being <br />responsible for all costs associated with the City's review and processing of the <br />
