7.1.D. - Page 1 REPORT To the Honorable Mayor and City Council From the City Manager September 23, 2013 SUBJECT Amendment No. 1 to the Professional Services Agreement with Moore lacofano Goltsman Inc. (MIG) for professional environmental planning services related to the Pete's Harbor project. RECOMMENDATION By motion, approve, and authorize City Manager to execute, Amendment No. 1 to the Professional Services Agreement with MIG in the amount of $37,542 to provide professional environmental planning services, including the preparation of an Addendum to the previously certified Final Environmental Impact Report, for the Pete's Harbor project, resulting in a total Agreement amount of $95,847. BACKGROUND On September 25, 2012, the original agreement was executed with Moore lacofano Goltsman, Inc. (MIG) for professional environmental planning services to provide project environmental review, documentation, and public outreach associated with the environmental review for the Pete's Harbor project. The initial contract amount was $58,305. ANALYSIS Amendment No. 1 in the amount of $37,542 provides ongoing professional environmental planning services due to the extended review and processing of the proposed project pursuant to an appeal to the City Council, remand back to the Planning Commission, modification to project design and scope by the Applicant, and unforeseen ownership and lease disputes. MIG is specifically preparing an Addendum to the certified Final Environmental Impact Report for the Marina Shores Village Project (June, 2003). The overall contract amount, including this amendment, will total $95,847. ALTERNATIVES Council may choose not to approve the proposed amendment. FISCAL IMPACT The Pete's Harbor project is a cost recovery project, with the Applicant being responsible for all costs associated with the City's review and processing of the
