For the reasons set forth below, we believe that the <br />decision of the City of Redwood City ("City") to issue a revised "Final" EIR, rather than <br />a revised "Draft" EIR, and to deprive the public of the mandatory comment period <br />applicable to recirculated EIRs, is contrary to the requirements of the California <br />Environmental Quality Act, Public Resources Code section 21000, et. seq. ("CEQA"). To <br />remedy this violation of state law, we therefore request that the Planning Commission <br />postpone the hearing currently scheduled for February 26, 2013, re -issue the RFEIR as a <br />revised Draft EIR, and allow the public adequate time (45 days) to review and comment <br />on the revised environmental document. <br />Public Resources code section 21092.1 provides that a city or county must <br />recirculate an EIR where significant new information is added prior to certification. See <br />also CEQA Guidelines § 15088.5(a) (public agency must recirculate an EIR if <br />"significant new information is added to the EIR after public notice is given of the <br />availability of the draft EIR for public review ..."). Recirculation ensures that CEQA's <br />public participation goals are met by "bolstering the public's confidence in the agency's <br />decision and providing the agency with information from a variety of experts and <br />
