7.3.B. - Page 1 RE PO RT To the Honorable Mayor and City Council From the Cit Mana er October 7, 2013 SUBJECT Annexation of Territory to the Emerald Lake Heights Sewer Maintenance District for Sewage Transmission, Treatment and Disposal Pursuant to Supplemental Agreement No. 36. RECOMMENDATION Approve, by resolution, the execution of Supplemental Agreement No. 36 with the County of San Mateo relating to sewage transmission, treatment and disposal; and consent to the annexation of Assessor's Parcel No. 068-120-360 to the Emerald Lake Heights Sewer Maintenance District . BACKGROUND On August 22, 1983, Redwood City ("City") entered into an Agreement for Sewage Transmission, Treatment and Disposal of Sanitary Sewerage with the County of San Mateo and the Emerald Lake Heights Sewer Maintenance District ("ELHSMD"). Pursuant to the Agreement, the County of San Mateo and the subject property owner, Patrick Mokhtarzadeh, have requested permission from the City to annex the property to the ELHSMD for sewer service. ANALYSIS The subject property is located within the City and is currently being served by a septic system. The closest sewer system the property can connect to is the system owned by the ELHSMD, which is administered by the County of San Mateo. The ELHSMD's sewer system eventually connects to the City's sewer system before entering the treatment plant. The Agreement allows for such annexation requests, subject to the following conditions: 1. Property owners pay the Wastewater Treatment Capacity Fee 2. Property owners pay the Sewer System Capital Facilities Fee 3. Execution of a Supplemental Agreement between the City and County. ALTERNATIVES Council may choose not to approve the annexation, which would be contrary to the ELHSMD Agreement approved by City Council on August 23, 1983.
