Air Quality Impacts: <br /> The Appellant claims that there is a high likelihood that the construction- <br /> related air quality impacts will affect her son's ability to breathe (Appellant <br /> states that her son suffers from asthma). Appellant cites that the IS/MND <br /> found that construction-generated dust would result in a short-term <br /> significant air quality impact. <br /> The IS/MND found that construction-generated dust would result in a <br /> short-term significant air quality impact that could be reduced to a less <br /> than significant level by implementing Bay Area Air Quality Management <br /> District (BAAQMD) best management practices as identified in the air <br /> quality mitigation measure, MM AIR-1 (Attachment 2, p. 24; Attachment 4, <br /> p. 2-3). <br /> c. Noise Impacts: <br /> The Appellant claims that the peace of the neighborhood will be <br /> significantly impacted by the noise of demolition and construction between <br /> the hours of 7:00 a.m. and 8:00 p.m. <br /> The IS/MND found that construction of the proposed project would expose <br /> nearby residents to temporary elevated noise levels that could be reduced <br /> to a less than significant level by implementing standard construction <br /> noise control measures as identified in the noise quality mitigation <br /> measure, MM NOI 2-1 (Attachment 2, p. 60; Attachment 4, p. 5-7). <br /> 5. Public Records Request <br /> As part of the appeal, the Appellant requested all permits, documents, email <br /> correspondence and any other relevant information. <br /> On July 26, 2013, the City responded to the Appellant's public records request <br /> and informed the Appellant that the requested information is available. To date, <br /> the Appellant has not responded to the City's notification and has not reviewed <br /> the requested records. <br /> ALTERNATIVES <br /> 1. Deny the appeal and uphold the Planning Commission's approval of the PD <br /> Permit with modified and/or additional conditions of approval. <br /> 2. Approve the appeal and deny the Planning Commission's approval of the PD <br /> Permit, and direct the applicant to redesign the project. <br /> FISCAL IMPACT <br /> None. <br /> ENVIRONMENTAL REVIEW <br /> The 1410 Valota Road Residential Project IS/MND was adopted by the Planning <br /> Commission per Resolution No. 12-08 on April 3, 2012 (Attachment 4).
