A7TACHMENT 1 WHEREAS, the City has agreed to incorporate in the Project all applicable mitigation measures identified in the ISIMND and the associated MMRP to reduce environmental impacts to less than significant levels; and WHEREAS, the Planning Commission has re�iewed the Project's pians and all en�ironmental documents and supporting studies and reports necessary for recorrlmending adoption of the ISIMND and recommending approval of the Project design; and has considered the foregoing at a duly noticed public hearing on October 15, 2Q13; and WHEREAS, by this resolution, the City, as the fead agency under CEQA, desires to comply with t�e requirements of CEQA, the CEQA Guidelines, the applicable pra�isions of the California Government Code, and the applicable pro�isions of the City's Zoning Ordinance and Municipal Code, in connection witf� the appro�al and subsequent impfementatian of the Project. NQW THEREFORE, BE !T RESOLVED BY THE PLANNiNG COMMISSIQN OF THE CITY OF REDWOOD CITY, AS FOLL4WS: A. The IS/MND {attached hereto as Exhibit A) and the assaciated MMRP (attached hereto as Exhibit B)are hereby recommended for adoption by the City Council based on the foElowing findings: 1. The abo�e recitals are true and correct and together with the Staff Report and the application materials, including without limitation the ISIMND and all other documents, reports, studies, memoranda, maps,oral and written testimany,and materials in the City's file for the application and #he Project, ar�d all adopted City planning documents relating to the U.S. Highway 101 Pedestrian Undercrossing and Bair Island Road Storm DraiR Pump Station Project and the prope�ty including the City's Generaf Plan, Zoning Ordinance, and other applicable City laws and regulatiar�s and associated appro�ed and certified en�ironmentaf documents, have together served as an adequate and appropriate evidentiary basis for the findings and actions set forth in this Resolution. 2. The City of Redwood City is the lead agency under the California En�ironmental Quality Act (CEQA) for prepari�g the ISIMND, and the City Council is the entity with final decision-making authority with regard to approval af the U.S. Highway 101 Pedestrian Undercrossing and Bair Island Road Storm Drain Pump Station Project. 3. The Planning Commission finds tha#the ISIMND for the Project was presented to the Planning Commission, that the ISIMND was prepared, published, circulated, reviewed and completed in full compliance with State law ar�d CEQA Guidelines, that there was adequate public review of the ISIMND, that it has consider�d the ISIMND and al! oamments on the ISIMND, that the ISIMND adequately disc�sses all significant environmenfal issues, ar�d that the ISIMND reflects the independent judgment and analysis of the Planning Commission and the City af Redwood City.
