For construction activity resulting in a land disturbance of one acre or more, applicant shall file a Noiice of Intent (NOI) with the State Water Resources Control Board under the Construction Activities Storm Water Generat Permit {General Permit). The NOI indicates the applicanfs intent to comply with the San Meteo Countywide Stormwater Pollution Prevention Program, including a Stormwater Pollution Prevention Plan (SWPPP),www scrcb.ca.qov/stoormwtr/construction.html Verification that the NOI has been submitted to the State Water Resources Control Board must be provided prior to issuance of any Building or Construction Permit. 24. If construction is not complete by the start of the wet season (October 1 through April 30), the applicant shall implement a winterization program to minimize the potential for erosion and sedimentation. As appropriate to the site and status of construction, winterization requirements shall include inspecting/maintaining/cleaning ail soil erosion and sedimentation controls prior to, during, and immediately after each storm event; stabilizing disturbed soils through temporary or permanent seeding, mulching, matting, tarping or other physical means; rocking unpaved vehicle access to limit dispersion of much onfo public right-of-way; and covering/tarpi�g stored construction materiais, fuels, and other chemicals. Plans to include proposed measures to prevent erosion and poliuted runoff from all site conditions shall be submitted for approval by COD prior to beginning construction. As site conditions warrant, the City Engineer may direct the appiicant to implement additional winterization requirements. 25. Applicant shall adhere to the Subdivision Map Act and Chapter 30 of ihe City's Municipal Code. 26. Prior to or concurrent with Final Map approval, the ownerlapplicant shall enter into a Landscape Maintenance Agreement (LMA) for ali assigned landscape areas in public right of way io be maintained. Maintenance items shall include sidewalk, planting not limited to trees, shrubs, flowers, grass, and all appurtenances including irrigation systems, pedestrian scale lighting, and skreet furniture. 27. Prior to or concurrent with Final Map approval, the owner/applicani shall enter into a Stormwater Treatment Measures Maintenance Agreement for all an-site stormwater treatment measures associated with the project. 28. Prior to or concurrent with Finaf Map approval, the owner/applicani shall enter into a Improvement Agreement to guaranYee the installation of ail improvements required of the project and to provide for payment oF all City inspection and pian check charges associated with the installation of public and private improvements, including, but not timited to, streets, sidewalks, sanitary sewers, water, storm drains and street lighfs. 29.
