ORIGIN�,�. AGREEMENT (NICHOLS DIAMOND TOOL, INC.) HIS AGREEMENT is made and entered into as of the � day of tf , 2013, by and between the CITY OF REDWOOD CITY, a cha ity and municipal corporation of the State of California ("City"), and NICHOLS DIAMOND TOOL, INC., ("Contractor"). RECITALS A. City requires Contractor's services to pertorm the concrete wall saw-cutting in the City's Main Library located at 1044 Middlefield Road, Redwood City, CA 94063. B. Contractor has the necessary experience in concrete wall saw-cutting work. C. Selection of Contractor is expected to achieve the desired results in an expedited fashion. D. Contractor has submitted a proposal to City and has affirmed its willingness and ability to perform such work. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, the Parties agree as follows: 1. Scope of Work and Time for PerFormance. Contractor shall pertorm everything required to be pertormed, shall provide and furnish all of the labor, equipment, materials, and tools to pertorm, within thirty (30) calendar days after the NOTICE TO PROCEED, the following work: REDWOOD CITY PUBLIC LIBRARY CONCRETE WALL PENETRATION 1044 MIDDLEFIELD ROAD in strict accordance with the Planspertaining thereto as described in Exhibit "A", attached hereto and incorporated herein, signed by the City Engineer of Redwood City, which Plans are incorporated herein and made a part of this Agreement as if herein fully set forth. 2. Compensation. City shall pay to Contractor, as full consideration for the faithful perFormance by Contractor of the aforementioned work, the amount of Nine Thousand Seven Hundred Thirty Five Dollars ($9,735.00) computed in accordance with Contractor's accepted Proposal dated October 4, 2013.
