4.4.A. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> December 9, 2013 <br /> SUBJECT <br /> Ordinance Adding Article XI (Recycling and Salvaging of Construction and Demolition <br /> Debris) to Chapter 9 (Buildings) of the Redwood City Municipal Code <br /> RECOMMENDATION <br /> 1. Waive First Reading and Introduce an Ordinance Adding Article XI (Recycling <br /> and Salvaging of Construction and Demolition Debris) to Chapter 9 (Buildings) of the <br /> Redwood City Municipal Code; and <br /> 2. Review and Approve the CEQA Exemption Determination. <br /> BACKGROUND <br /> On October 21, the City Council was presented with the attached draft ordinance for <br /> discussion and public comment. <br /> ANALYSIS <br /> The key components of the proposed ordinance are as follows: <br /> 1. The ordinance would apply to all residential and non-residential new construction, <br /> roofing, and full demolition projects; <br /> 2. Covered Projects would be required to achieve a 60% landfill diversion and recycling <br /> ("recycling") rate; <br /> 3. Demolition projects would also be required to recycle 100% of all inert materials; <br /> 4. The ordinance would apply to all alteration or addition projects valued at $50,000 or <br /> more; <br /> 5. An administrative fee would be assessed to offset costs of staff time; <br /> 6. A deposit would be charged at the beginning of the permit process, to be returned to <br /> the applicant, without interest, upon proof of compliance with the 60% recycling rate; <br /> and <br /> 7. Provisions for a "good faith effort" would be included if the 60% requirement is not <br /> met, considering such factors as the availability of markets for the C&D debris, size <br /> of the project, and the documented efforts of the applicant to divert the C&D debris. <br /> Adoption of this ordinance will help Redwood City comply with the California lntegrated <br /> Waste Management Act of 1989 (California Public Resources Code Sections 40000 et <br /> seq.) which encourages the establishment of programs to divert materials from landfill <br /> disposal, such as those for recycling and salvaging of C&D materials. The ordinance <br /> also supports the City's green building environmental goals set forth in Chapter 9, <br />
