Groundwater VOC and Fuel General Permit ORDER NO.R2-2012-0012 <br /> NPDES NO.CAG912002 <br /> C. Special Provisions <br /> 1. Reopener Provisions <br /> The Regional Water Board may modify or reopen this Order prior to its expiration date in <br /> any of the following circumstances as allowed by law: <br /> a. If present or future investigations demonstrate that the discharges governed by this Order <br /> have or will have a reasonable potential to cause or contribute to, or will cease to have, <br /> adverse impacts on water quality or beneficial uses of the receiving waters. <br /> b. If new or revised WQOs or total maximum daily loads (TMDLs) come into effect for the <br /> San Francisco Bay Estuary and contiguous water bodies (whether statewide,regional, or <br /> site-specific). In such cases, effluent limitations in this Order will be modified as <br /> necessary to reflect updated WQOs and waste load allocations in TMDLs. Adoption of <br /> effluent limitations contained in this Order is not intended to restrict in any way future <br /> modifications based on legally adopted WQOs or TMDLs, or as otherwise permitted <br /> under federal regulations governing NPDES permit modifications. <br /> c. If State Water Board precedential decisions,new policies,new laws, or new regulations <br /> on chronic toxicity or total chlorine residual become available. <br /> d. If an administrative or judicial decision on a separate NPDES permit or WDRs addresses <br /> requirements similar to this discharge. <br /> e. The Discharger may request permit modification based on any of the circumstances <br /> described above. In any such request, the Discharger shall include an antidegradation and <br /> anti-backsliding analysis. <br /> f. The California Department of Public Health established a notification level for 1, 4- <br /> dioxane in November 2010 and has determined that it is reasonably anticipated to be a <br /> human carcinogen. Although this Order does not provide an effluent limit for 1,4- <br /> dioxane,the Regional Water Board may reopen this Order prior to its expiration to revise <br /> permit provisions pertaining to 1,4-dioxane. <br /> g. Or as otherwise authorized by law. <br /> 2. NOI or Modified NOI Application. The NOI or Modified NOI application for each point of <br /> proposed discharge to a storm drain system shall contain the information required in the NOI <br /> Application as explained in Attachment B of this Order and as may be amended by the <br /> Executive Officer. <br /> 3. NOI Review. Upon receipt of a complete NOI application package for proposed discharge, <br /> the Executive Officer will review the application to deternune whether the proposed <br /> Discharger is eligible to discharge waste under this Order. The application package shall <br /> document that: <br /> a.
