[2] Drinking water azeas are defi�ed as surface waters with the existing or potential beneficial uses of"municipal and domestic supply"and <br /> "groundwater recharge°(the latter includzs recharge areas to maintain sah balance or to halt salt water intrusion into fresh water aquifers). <br /> [3} There shall be no detectable levels of residual chlorine in the effluent(a non-detect result using a detection level equal or less than 0.08 <br /> milligram per liter(mg/L)will not be deemed ro be out of compliance). This limit only applies to Dischargers that chlorinate their extracted <br /> groundwater. <br /> D. Compliance Summary <br /> Forty-four effluent limit and 171ate reporting violations (for a total of 61 violations) are <br /> reported in CIWQS during the term of the Fuel General Permit. On average,the Dischargers <br /> reported effluent limit compliance rates of about 99% for TPHd, TPHg, and on-time report <br /> submittal, and almost 100% for the remaining pollutants with effluent limits in Table F-2. <br /> Regional Water Board enforcement staff completed enforcement actions for 53 of these <br /> violations, and continues to review the remaining 8 violations. The VOC General Permit <br /> compliance summary is on page F-4 of Order No. R2-2009-0059. <br /> E. Planned Changes <br /> As required in Attachment D, a Discharger authorized under this Order shall submit a modified <br /> NOI before making any material change in the character, location, or volume of the discharge. <br /> III.APPLICABLE PLANS, POLICIES,AND REGULATIONS <br /> The requirements contained in the Order are based on the requirements and authorities described in <br /> this section. <br /> A. Legal Authorities <br /> This Order is issued pursuant to section 402 of the federal Clean Water Act(CWA)and <br /> implementing regulations adopted by the U.S.Environmental Protection Agency(USEPA)and <br /> chapter 5.5,division 7 of the California Water Code[(CWC),commencing with section 13370].It <br /> shall serve as a NPDES permit for point source discharges from these facilities to surface waters. <br /> This Order also serves as General Waste Discharge Requirements(GWDRs)pursuant to CWC <br /> article 4,chapter 4,division 7(commencing with section 13260). States may request authority to <br /> issue general NPDES pernuts pursuant to Code of Federal Regulations,Title 40,Chapter 1, <br /> Subchapter D,part 122.28(40 CFR 122.28).40 CFR 122.28 provides for the issuance of general <br /> pernuts to regulate discharges of waste which result from similar operations,are the same types of <br /> waste,require the same effluent limitations,require similar monitoring,and are more appropriately <br /> regulated under a general perxnit rather than individual permits.This general pernut meets the <br /> requirements of 40 CFR 12228 because the discharges and proposed discharges: <br /> • result from similar operations (all involve extraction,treatment,and discharge of <br /> groundwater); <br /> • are the same types of waste(all are groundwater containing VOC, fuel components,and <br /> other related wastes due to leaks and spills); <br /> • require similar effluent limitations for the protection of the beneficial uses of surface waters <br /> in the San Francisco Bay Region(this general permit does not cover direct discharges to the <br /> Pacific Ocean); <br /> Attachment F—Fact Sheet F-8 <br /> For VOC and Fuel General NPDES Permit No.CAG912002 <br />
