Water Quality-Based Effluent Limitations (WQBELs) <br /> WQBELs have been derived to implement WQOs that protect beneficial uses.Both the beneficial <br /> uses and the WQOs have been approved pursuant to federal law.The procedures for calculating <br /> individual WQBELs are based on the SIP and the Basin Plan.Most Basin Plan beneficial uses and <br /> WQOs were approved under State law and submitted to and approved by USEPA prior to May 30, <br /> 2000. Any WQOs and beneficial uses submitted to USEPA prior to May 30,2000,but not approved <br /> by USEPA before that date,are nonetheless"applicable water quality standards for purposes of the <br /> [Clean Water]Act"pursuant to 40 CFR 131.21(c)(1). Collectively,this Order's restrictions on <br /> individual pollutants are no more stringent than those required by CWA water quality standards. <br /> 1. Scope and Authority <br /> a. 40 CFR 122.44(d)(1)(i)mandates that permits include effluent limitations for all <br /> pollutants that are or may be discharged at levels that have reasonable potential to cause <br /> or contribute to an excursion of a water quality standard, including numeric and nanative <br /> objectives within a standard. As specified in 40 CFR 122.44(d)(1)(i),permits are required <br /> to include WQBELs for all pollutants"which the Director determines are or may be <br /> discharged at a level which will cause,have the reasonable potential to cause, or <br /> contribute to an excursion above any state water quality standard." <br /> The process for determining "reasonable potential"and calculating WQBELs when <br /> necessary is intended to protect the designated beneficial uses of the receiving water as <br /> Attachment F—Fact Sheet F-15 <br /> For VOC and Fuel General NPDES Permit No.CAG912002 <br />
