Article 5—Obliga�ions <br /> A. Welcome Packet <br /> The City agrees to provide MuniServices with a Program Welcome Packet, including, but not <br /> limiCed to: <br /> i. A copy of the Cit3�s UUT Ordinance and any amendments thereto. <br /> 2. Two letters requesting the exemption lists from the utiliry companies to be placed on City <br /> letterhead and returned to MuniServices. <br /> 3. A Letter of Authorization for MuniServices to act on City's behalf. Place on Ciry letterhead <br /> and returned to MuniServices. <br /> 4. A sample remittance form ta be provided to the utility companies if the City doesn't <br /> currently have a for�n far this purpase. <br /> 5. Two SB278 letters requesting fr�om utility companies to provide a transportation list,These <br /> letters should be piaced on City letterh.ead and returned tn MuniServices. <br /> B. Necessary Information <br /> The City wili provide MuniServices, on a timely basis, with informativn necessary to <br /> conduct its compliance review activities including but not limited to: monthly UUT <br /> payment histories, exernption lists, and SB 278 gas and electric lists (including names of <br /> customers refusing ta pay surcharges), and of any subsequent amendments to the UUT <br /> ordinance. <br /> C. Regarding the City-Specific Audits <br /> City agrees to: <br /> I. Provide administrative subpoenas as needed for access to Che books and records of the <br /> utility. <br /> 2. Provide a specific Letter of Authorization far MvniServices addressed to the specific utility <br /> for the specific audit <br /> 3. Invoice the responsible party for tax deficiencies (plus interest and penaIties if applicable) <br /> identiFed and confirmed by MuniServices within thirty (30) days following receipt of <br /> MuniServices detection report or correspondence. <br /> 4. Provide MuniServices with a capy of any settiement agreement with a taxpayer/t� <br /> cotlector within ten(10}days of entering inCo such agreement;and, <br /> D. Natiflcation <br /> iVotify MuniServices within ten (10) days following receipt by the City of payments that are a <br /> direct result af MuniServices campliance and/or audit services (cash, installment, or other <br /> compensation directly benefitting the City) of such tax deficiencies, whether invoiced or not. <br /> Upon receipt of such notice,MuniServices will promptly invoiee the City[iE applicable). <br /> E. Legal Interpretations of Ordinance <br /> Upon request, the Ciry will provide MuniServices with appropriate legal and <br /> administrative interpretations af its UUT ordinance. it is agreed and understaod that the <br /> City will retain the exclusive authority and responsibility t� administer, interpret, and <br /> enforce its UUT ardinance, recognizing that the role of MuniServices is limited to <br /> empioying their unique expertise and proprietary tools for: i� detecting and identifying <br /> ATTY/AGRj2013.494JMUNl SERVICES(UUT) <br /> REV:06-0413 MLG <br /> Page 17 of 19 <br />
