manager, contractor, and all subcontractors who are responsible for grading and erosion <br /> and sedimentation protection controls. <br /> 21 . The Applicant shall provide "as-built" drawings to the Engineering Department, prepared <br /> by a registered Civil Engineer. The Applicant's Engineer of Record shall perform field <br /> work to verify that the "as-built" drawings are in substantial compliance with the field <br /> conditions. "As-built" plans shall be submitted to the Engineering Department on original <br /> tracing or permanent mylar. AutoCAD drawings of as-built drawings shall be provided for <br /> file <br /> 22. Normally scheduled construction activities shall adhere to the City's Noise Ordinance. If <br /> possible, the noisiest construction activities would be scheduled for daytime hours when <br /> the ambient noise levels are highest. <br /> 23. All construction equipment operated at the project site should be equipped with <br /> manufacturer's standard noise control devices (i.e. mufflers, engine enclosures, etc.). <br /> 24. All construction equipment shall be Inspected by the contractor at periodic intervals to <br /> ensure proper maintenance and hence, lower noise levels. <br /> 25. The Applicant shall submit a tree protection plan showing that all trees 12-inches In <br /> diameter and larger to remain will be protected during construction. <br /> 26. The Applicant shall ensure that traffic control for lane closures will conform to the Work <br /> Area Traffic Control Handbook. The Applicant shall submit a traffic control plan for street <br /> closures to the Engineering Department for review and approval. <br /> 27. Applicant shall adhere to the Subdivision Map Act and Chapter 30 of the City's Municipal <br /> Code. <br /> 28. The owner/Applicant shall file a Final Map prior to the issuance of building permits. <br /> 29. Applicant shall submit Covenants, Conditions and Restrictions (CC&R's) to the City for <br /> review and approval. The CC&R's shall provide for the maintenance of all infrastructure <br /> and utilities within the Project site or constructed to serve the Project which serve two or <br /> more units and are not accepted by the City or a utility company for maintenance. This <br /> shall include, but not be limited to, the private open spaces, shared parking spaces, <br /> common walkways, common landscaping, and the stormwater drainage and sewer <br /> collection systems. The CC&R's shall be submitted to the City Engineer or designee for <br /> review and approval prior to Final Map approval. The CC&R's shall be recorded upon <br /> Department of Real Estate approval of the Condominium Plan, prior to Final Occupancy. <br /> 30. Prior to Final Map approval, the Owner/Applicant shall enter into a Landscape <br /> Maintenance Agreement (LMA) for all assigned landscape areas in public right of way, <br /> easements and/or on property where the City holds an interest to be maintained. <br /> Maintenance items shall include planting not limited to trees, shrubs, flowers, grass, and <br /> all appurtenances including irrigation systems and pedestrian scale lighting.
