Subsequent to the City Council's action, the City held an election and re- <br /> organized itself. Diane Howard is now filling the seat left open by Council Jeff Ira who <br /> reached his maximum term limit. Because Council Member Howard was not part of the <br /> original vote, she will not vote on this resolution. The remaining six Council Members <br /> participated in the appeal hearing and may vote. <br /> ANALYSIS <br /> With the submittal of its 2011 application, LWJV proposed home sizes ranging <br /> from 3,300 to 4,500 buildable square feet (including garage), with an average of <br /> 3,809 square feet (see Table 1, "2011 Application" column, for maximum allowable <br /> square footage by lot number and APN). <br /> On March 26, 2013, the Planning Commission certified the RFEIR and approved a <br /> Planned Development Permit for the development of the Laurel Way Joint Venture <br /> Project. Although the applicant had requested larger home sizes be approved, the <br /> Planning Commission approved the project with smaller homes in accordance with <br /> Alternative B of the RFEIR. Alternative B applied a formula based on average slope of <br /> the lot, with at least 2,000 square feet of maximum floor area (including garage) on each <br /> lot. The Planning Commission also guaranteed a home size of at least 2,000 square <br /> feet of livable space by excluding a garage (approximately 400 square feet) from the <br /> space counted for the purpose of the maximum allowable floor area. Accordingly, the <br /> smallest homes could have up to 2,400 square feet of maximum floor area when <br /> including the garage. The Planning Commission's determination is reflected in <br /> Condition No. 19 of the Planning Commission Resolution No. 13 -04. [See Table 1, <br /> "Planning Commission Approval" column, for maximum allowable square footage <br /> (including garage) by lot number and APN]. <br /> Both SLW and LWJV appealed the Planning Commission's decision. SLW challenged <br /> the Planning Commission's decision on a number of grounds arguing in part for <br /> less development. LWJV appealed only Condition No. 19 of the Planning <br /> Commission's decision contending larger home sizes were appropriate. <br /> In the exercise of its independent judgment, the City Council determined that it was <br /> appropriate to approve the development in accordance with Alternative B of the <br /> RFEIR. Accordingly, the City Council modified Condition No. 19 to conform home sizes <br /> to those allowed under Alternative B of the RFEIR but without the revision that the <br /> Planning Commission had made. This change affects only seven lots. Property <br /> owners are guaranteed 2,000 square feet of maximum allowable floor area (including <br /> the garage) which means that a few homes (about 4) would have approximately <br /> 1,600 square feet of livable space (assuming a 400 sq. ft. garage). Some homes <br /> could be larger — at least two could be over 3,000 square feet (3,432 and 3,328). The <br /> average allowable floor space of the sixteen homes is 2,503 square feet.
