Provisions for a "good faith effort" would be included if the 60% requirement is <br /> not met, considering such factors as the availability of markets for the C &D <br /> debris, size of the project, and the documented efforts of the applicant to divert <br /> the C &D debris. <br /> ALTERNATIVES <br /> Council could determine to not adopt the proposed ordinance, thereby preventing the <br /> implementation of this environmental initiative. <br /> FISCAL IMPACT <br /> Adoption of the ordinance will have no fiscal impact to the City. Minimal additional staff <br /> time will be necessary to review C &D recycling plans and determine compliance. An <br /> administrative fee (based on the Master Fee Schedule) will be attached to the permit <br /> process to cover this staff time. Other than the administrative fee, there will be no fiscal <br /> impact to the building permit applicant unless the applicant does not comply with the <br /> ordinance. A deposit (based on Master Fee Schedule and placed in a fund designated <br /> to further promote the development and expansion of recycling and waste reduction <br /> programs) will be charged at the beginning of the permitting process and shall be <br /> returned upon proof that the applicant has diverted from landfills no less than the <br /> required percentage of C &D debris generated by the project. If a lesser percentage of <br /> tons than required were diverted, a proportionate share of the deposit will be returned <br /> and the City shall retain the remainder. The deposit shall be forfeited entirely if the <br /> applicant fails to comply with the landfill diversion requirements. <br /> ENVIRONMENTAL REVIEW <br /> The adoption of this ordinance is categorically exempt from CEQA pursuant to Section <br /> 15308 of the California Code of Regulations ( "CEQA Guidelines "), which exempts <br /> actions taken by regulatory agencies for enhancement or protection of the environment <br /> where the proposed regulation involves procedures for the protection of the <br /> environment. <br /> BILL EKERN <br /> COMMUNITY DEVELOPMENT DIRECTOR <br /> ROBERT B.
