7.3.A. - Page 15 <br /> Sec. 9.210. - Responsible Party: <br /> Every Applicant and /or owner of property on which a Covered Project occurs <br /> shall be responsible for compliance with the provisions of this Article. <br /> SECTION 2. Environmental Review. This Ordinance has been reviewed <br /> with respect to applicability of the California Environmental Quality Act ( "CEQA ") <br /> and the State CEQA Guidelines (California Code of Regulations, Title 14, <br /> Sections 15000 et seq., hereafter the "CEQA Guidelines "). The City has <br /> determined that the adoption of this ordinance is categorically exempt from <br /> CEQA pursuant to Section 15308 of the CEQA Guidelines which exempts <br /> actions taken by regulatory agencies for enhancement or protection of the <br /> environment where the proposed regulation involves procedures for the <br /> protection of the environment. <br /> SECTION 3. Severability: If any section, subsection, sentence, clause or <br /> phrase of the Ordinance is for any reason held to be invalid, such decision shall <br /> not affect the validity of the remaining portions of this Ordinance. The City <br /> Council hereby declares that it should have adopted the Ordinance and each <br /> section, subsection, sentence, clause or phrase thereof, irrespective of the fact <br /> that any one or more sections, subsections, sentences, clauses or phrases be <br /> declared unconstitutional. <br /> SECTION 4.
