Act (Title 14 California Code of Regulations Section 15000 et seq.; hereafter "CEQA Guidelines") on behalf of the City's Community Development Department; and WHEREAS, from January 20, 2009 through February 20, 2009 the City held a public review period on the Notice of Preparation (NOP) for the Project EIR. The City mailed, published and posted on its website a NOP to notify responsible agencies of the State Office of Planning and Research, all interested parties and surrounding property owners that an EIR would be prepared for the Project in accordance with Section 15082 of the California Environmental Quality Act (CEQA); and WHEREAS, on February 19, 2010, City staff issued a Notice of Availability to announce the availability of the Draft Environmental Impact Report for the Project ("Draft EIR") for public and responsible agency review and input; and WHEREAS, the Draft EIR was circulated for public review and comment for 45 days from February 19, 2010 to April 7, 2010, and was filed with the State Office of Planning & Research under State Clearinghouse No. 2009012058; and WHEREAS, on April 6, 2010, the Planning Commission held a duly noticed public hearing and received public testimony on the Draft EIR and the City received a number of letters and emails from the public during the Draft EIR public review period; and WHEREAS, on August 24, 2010, the Planning Commission held a duly noticed public hearing and voted to certify the EIR for the Laurel Way Project. On August 31, 2010, an appeal of the Planning Commission's certification of the EIR was filed by a resident on behalf of a neighborhood group. On August 22, 2011, the City Council considered the EIR appeal and by consensus the City Council directed revisions to the Final EIR and referred the matter back to the Planning Commission to reconsider the adequacy of the Revised Final EIR; and WHEREAS, a notice of the Planning Commission's public hearing on the Laurel Way Planned Development Project, including the Revised Final EIR, was mailed on February 13, 2013 and duly published in the Redwood City Daily News on February 16, 2013, and the Planning Commission held a public hearing on the Laurel Way Planned Development Project on March 26, 2013; and WHEREAS, on March 26, 2013, the Planning Commission held a public hearing, adopted Resolution No. 13-04 certifying the Revised Final EIR prepared by the City in accordance with the requirements of CEQA, adopting CEQA Findings of Fact, and ATTY/RE50.2935/RESO DENYING THE APPEAL OF LAUREL WAY RESO.#15311 REV:12-12-13 PT MUFF#603 Page 2 of 7
