8.B. - Page 2 <br /> which is costly, time consuming and has very strict findings in order for approval to be <br /> granted. <br /> As proposed in the draft Ordinance, the Zoning Administrator would have final approval <br /> authority over stand-alone Reasonable Accommodation requests or requests that are <br /> submitted with another development application requiring the Zoning Administrator's <br /> approval. The Planning Commission would have final approval authority over <br /> Reasonable Accommodation requests that are submitted with another development <br /> application requiring the Commission's approval (concurrent review and approval). This <br /> streamlined process will help to remove procedural barriers as well as allow for the <br /> relaxation or waiver of development standards in order to accommodate equal access <br /> to housing opportunities. <br /> As part of recent amendments to State statutes, cities are required to permit transitional <br /> and supportive housing as a matter of right, and may only subject these uses to <br /> restrictions that apply to other residential dwellings in the same zone. <br /> To comply with state law, amendments to the definition of "dwelling" are recommended <br /> to explicitly permit transitional and supportive housing (Attachment 2). This amendment <br /> is considered necessary to ensure the City qualifies for streamlined review of the <br /> Housing Element in the upcoming cycle. It is also recommended that the small <br /> residential care facilities, also mandated by the state as a permitted residential use, be <br /> included in the amended definition for more clarity. <br /> Staff reviewed model ordinances and other local municipalities' ordinances. "21 <br /> Elements" of San Mateo County, a collaborative organization where the 21 <br /> municipalities within San Mateo County share research and cooperate with various <br /> housing issues, developed a model ordinance which was used as a basis for the <br /> proposed procedures. Staff also researched a number of Reasonable Accommodation <br /> ordinances already approved and in use by other California jurisdictions including the <br /> cities of Camarillo, Davis, Mill Valley, Sacramento and Santa Rosa. <br /> ALTERNATIVES <br /> The City Council may consider alternative actions with respect to the proposed <br /> Ordinance, including the following: <br /> 1. Recommend the proposed Ordinance with minor modifications. <br /> 2. Direct staff to prepare significant modifications to the proposed Ordinance and to <br /> return to the Planning Commission with revised draft language for review. <br />
