Developer is the current fee owner of that certain real property consisting of <br /> approximately 2.0 acres located at 950 Middlefield Road within the City of Redwood City, <br /> County of San Mateo, State of California, described in Exhibits A-1 and A-2, attached hereto and <br /> incorporated herein by reference(the"Property"). <br /> B. On July 22, 2013, the City Council of the City of Redwood City adopted <br /> Resolution No. 15289, approving a Disposition and Development Agreement between the City <br /> and Developer("DDA"), and as of July 30, 2013, the DDA was fully executed. <br /> C. The DDA sets forth the terms and conditions for, among other things, <br /> development of the Property (the "Project"), and DDA Section 4.6.3 requires that Developer <br /> provide, or cause Developer's contractor to provide, a public improvement bond for the <br /> performance of work with respect to any public improvements constructed as part of the Project. <br /> D. On July 22, 2013, the City Council of the City of Redwood City also adopted <br /> Resolution No. 15288, approving a Planned Community Permit for the Crossing 900 Project at <br /> 950 Middlefield Road and a Vesting Tentative Parcel Map entitled "Vesting Tentative Parcel <br /> Map" prepared by Kier & Wright and dated June 10, 2013 ("Tentative Map"), subject to certain <br /> conditions of approval ("Conditions"). <br /> E.
