Advance Deposit Toward Fees And Costs Because new client matters involve both a substantial undertak.ing by our firm aiad the establishment of client credit with our accounting office, we generally r�c�uire an advance payment from elients. Thc amount of this advance deposit is determiued on a case-by-case basis discussed first wit11 the client, and any req�xired deposit is s�ecitied in our engagement letter. Upoii receipt, the advazace deposit will be dep�sited into the firnl's ctient trust aecount. Our monthly billings wil.l retlect such applicativns of the advance deposit ta costs and not to attorney's fees. At the end of engagement, we will. apply any remaining balance first to costs and theil to fees. We also reserve the right to require incrEas�s ar renewals of tliese advanced depasits. By signing the initial engagenlent letter, eacl� clieilt is agreeing that tcust account balances may be withdrawn and applied to costs as thcy are incurred and ta our billings, after presentation. to t].�e client. If we succeed in resolving yaur matter before the amounts deposited are used, any balance will be promptly refunded. Monthly I�ivoices and Payment Best Best & Krieger LLP provides our clients witli monthly invoices for legal services gerfonned and expenses incurrcd. Invoices are duc and payable upon receipt. Each monthly invoice reflects both professional and other fees for services rendered through tlae eud of the prior n�onth, as weil as expenses incurred on the client's behalf that have been processcd by the cnd of tl�e prior month. Processing of some ex�enses is delayed uiltil the ��ext month and billed th�reafter. Our fees are nnt contingent upon any aspeet oF the matter and are due upon rcceipt. AII biliings are due and payable tivithin ten days of presentatio�i imless Che filll amot�nt is covered by the balance of an advance held in our trust accoiu�t. If a bill is not paid within 30 days, a late charge of one percent per month on the tcnpaid invoice shall be added to the balance owed, commencing with the next statement and continuing until paid. It is our policy to treat every question abaut a bill promptly and fairly. It is alsa our policy that if a cIient daes not pay at� ir�voice wilhin b0 days af mailing, we assume the clicnt is, for�vhatever reason, rEfusing to pay. We will then advise the client by letter that the client may pay the ii�voice within 14 days or the firm will take appropriate steps to withdraw as attorney of record. If the delay is caused by a problem in the invoice, we must rely upou the client to raise that with i�s during the l4-day period. This sanle pnlicy applies to fee arrai�gemeizts wllich require the client to replenish fee deposits ar make deposits for anticipated costs.
