7.1.D. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> February 10, 2014 <br /> SUBJECT <br /> Approve Supplemental Agreement VI to Joint Exercise of Powers Agreement (JPA) with <br /> South Bayside System Authority <br /> RECOMMENDATION <br /> By motion, adopt Resolution approving and authorizing execution of Supplemental <br /> Agreement VI to the JPA, and authorizing City Manager to execute Supplemental <br /> Agreement VI to the JPA. <br /> BACKGROUND <br /> On January 27, 2014, the City Council reviewed staff's request to approve <br /> Supplemental Amendment VI to the JPA. Attached to this report is the correct <br /> Resolution approving and authorizing execution of Supplemental Amendment VI to the <br /> JPA. <br /> ANALYSIS <br /> Staff recommends that Council approve the attached Resolution for the reasons set <br /> forth in the January 27, 2014 staff report. <br /> ALTERNATIVES <br /> Do not execute Supplement Agreement VI until a new amendment is presented. <br /> FISCAL IMPACT <br /> Realigns the City's payment of capital costs with City's share of plant capacity. <br /> ENVIRONMENTAL REVIEW <br /> This activity is not a project under CEQA as defined in CEQA Guidelines, section <br /> 15378, because it has no potential for resulting in either a direct or foreseeable physical <br /> change in the environment. <br /> PAMELA THOMPSON <br /> CITY ATTORNEY <br />
