7.4.A. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> February 10, 2014 <br /> SUBJECT <br /> Zoning Code Amendments for Reasonable Accommodation, Transition and Supportive <br /> Housing and Small Residential Care Facilities <br /> RECOMMENDATION <br /> Waive the Second Reading and Adopt an Ordinance to (1) add Article 56 establishing a <br /> Reasonable Accommodation Ordinance and (2) amend Article 2 revising the definition <br /> of dwelling to include transitional housing, supportive housing, and small residential <br /> care facilities as mandated by State law. <br /> BACKGROUND <br /> On January 27, 2014, the City Council introduced the above ordinance amending the <br /> Zoning Code. If adopted, this ordinance will be effective on Wednesday, March 12, <br /> 2014. <br /> ANALYSIS <br /> Adoption of this ordinance implements provisions of the City's 2010-2014 General Plan <br /> Housing Element and qualifies the City for an expedited review of the 2014 Housing <br /> Element update. Further analysis of the ordinance was provided in the Staff Report to <br /> City Council on January 27, 2014. <br /> ALTERNATIVES <br /> 1. Adopt the ordinance with changes, which could require additional environmental <br /> review. <br /> 2. Do not adopt the ordinance, disqualifying the City for streamlined Housing <br /> Element review. <br /> FISCAL IMPACT <br /> No fiscal impact is expected with this project. <br /> ENVIRONMENTAL REVIEW <br /> The Ordinance is subject to Section 15183 of the California Environmental Quality Act <br /> Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.) because <br /> the action to adopt a process for Reasonable Accommodation and to permit transitional <br /> and supportive housing is covered within the City's adopted General Plan for which an <br /> Environmental Impact Report was certified, and as such has been mitigated. <br />
