7.4.A. - Page 4 ATTACHMENT 1
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY
DOES ORDAIN AS FOLLOWS:
Section 1. The recitals set forth above are true and correct, and are hereby
incorporated herein by this reference as if fully set forth in their entirety.
Section 2. This Zoning Ordinance Amendment was presented to the City
Council at its meeting on January 27, 2014, was filed and made available at the Office
of the City Clerk, and is incorporated herein by this reference.
Section 3. This Zoning Ordinance Amendment has been reviewed by the City
Council with respect to applicability of the California Environmental Quality Act
("CEQA") and the CEQA Guidelines (California Code of Regulations, Title 14, Sections
15000 et seq.). The proposed ordinance is subject to Section 15183 of the CEQA
Guidelines because the action to adopt a process for Reasonable Accommodation and
to permit transitional and supportive housing is covered within the City's adopted
General Plan for which an Environmental Impact Report was certified, and as such has
been mitigated.
Section 4. Based on the facts in the staff report, written and oral testimony, and
exhibits presented, the City Council finds the Zoning Ordinance Amendment to be in the
public interest and in conformance with the General Plan and the goals and objectives
of Article 41 of the Zoning Ordinance.
Section 5. The City Council hereby adopts the Zoning Ordinance Amendment
as follows:
a. Article 2, Definitions, of the Redwood City Zoning Ordinance is
amended by adding the text shown in underline (example), as provided in Exhibit
A. (New definitions shall be inserted into the Zoning Ordinance in alphabetical
order.)
b. Article 56, Reasonable Accommodation, is added to the Redwood
City Zoning Ordinance, in substantially the form attached hereto as Exhibit B.
Section 6. If any section, subsection, clause or phrase of this Ordinance is for
any reason held to be invalid, such decision shall not affect the validity of the remaining
portion or sections of the Ordinance. The City Council of the City of Redwood City
hereby declares that it would have adopted the Ordinance and each section,
subsection, sentence, clause or phrase thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared
unconstitutional.
ATTY/ORD.399/REASONABLE ACCOMODATION&HOUSING ZONING AMENDMENTS
REV: 12-20-13 VR
