02/10/2014 <br /> 56.5 Process for Review <br /> A. An applicant shall submit an application and all supplemental documents in <br /> accordance with Section 56.4. <br /> B. Upon submittal of an application including materials described in Section <br /> 56.4, the Zoning Administrator will review the application if there is no <br /> accompanying land use or development application. If the Reasonable <br /> Accommodation request is submitted with another application land use or <br /> development application, then the Reasonable Accommodation request will <br /> be reviewed and acted on concurrently by the appropriate reviewing <br /> authority for the land use or development application. <br /> C. A hearing is not required for a Reasonable Accommodation request; <br /> however, to the extent a hearing is required for any accompanying land use <br /> or development application, the Zoning Administrator or other appropriate <br /> reviewing authority shall include the Reasonable Accommodation request <br /> as part of the hearing. <br /> D. The Zoning Administrator or other appropriate reviewing authority shall <br /> issue a Notice of Official Action or Notice of Final Decision, as applicable. <br /> 56.6 Action <br /> The Zoning Administrator or other appropriate reviewing authority may take <br /> the following actions in response to a Reasonable Accommodations request: <br /> A. Request additional information within 30 days of application submittal. <br /> B. Approve as submitted or with modifications and/or conditions. <br /> C. Deny. <br /> The Notice of Official Action or Notice of Final Decision, as applicable, shall <br /> be provided to the applicant within 45 days of application submittal (or within <br /> 45 days of receiving additional required information). <br /> 56.7 Findings <br /> To permit the Reasonable Accommodation, the Zoning Administrator or other <br /> appropriate reviewing authority must make all of the following findings: <br /> A. That an individual residing on the property and requiring reasonable <br /> accommodation is protected under the Acts; and <br /> B. That accommodating the request would provide direct benefit to the <br /> individual by meeting specific housing needs; and. <br /> C. That the request is the minimum necessary to provide the necessary relief <br /> from the City's Zoning Ordinance to meet the needs of the individual; and <br /> D. That the request is not detrimental to and will not adversely impact the <br /> adjacent properties or surrounding neighborhood; and <br /> E. That the request does not place an undue financial or administrative <br /> burden on the City; and <br /> F.
