ATTACHMENT 1 <br /> • New landscaping and maintenance of existing mature landscaping as <br /> feasibly possible; and <br /> O Compliance to all applicable zoning regulations. <br /> 8. The lots may only be developed with one (1) detached single-family <br /> dwelling each; duplexes are prohibited. <br /> 9. The applicant/contractor shall obtain an Encroachment Permit from the <br /> Community Development Department (CDD) for work in the City public <br /> right-of-way, easements or property in which the City holds an interest. <br /> 10.The applicant shall obtain an Encroachment permit with Engineering <br /> Services prior to the commencement of construction of the road, utilities, <br /> and/or any site improvements. <br /> 11.Prior to Final Map approval, the owner/applicant shall enter into a <br /> Landscape Maintenance Agreement (LMA) in a form acceptable to the <br /> City Attorney for all assigned landscape areas in public rights of way or <br /> public access easements to be maintained. Maintenance items shall <br /> include planting not limited to trees, shrubs, flowers, grass and all <br /> appurtenances including irrigation systems and pedestrian scale lighting. <br /> 12.Prior to Final Map approval, the owner/applicant shall enter into a <br /> Stormwater Treatment Measures Maintenance Agreement in a form <br /> acceptable to the City Attorney for all on-site stormwater treatment <br /> measures associated with the project. <br /> 13.Prior to Final Map approval, the owner/applicant shall enter into an <br /> Improvement Agreement in a form acceptable to the City Attorney to <br /> guarantee the installation of all improvements required of the project to <br /> provide for payment of all City inspection and plan check charges <br /> associated with the installation of public and private improvements, <br /> including, but not limited to, streets, sanitary sewers, water, storm drains <br /> and street lights. <br /> 14.Applicant shall submit proposed Covenants, Conditions and Restrictions <br /> (CC&R's) for review and approval by the City prior to any Final Map <br /> approval. All property owners must be members. The submittal shall <br /> include an estimate of costs and proposed level of maintenance for each <br /> of the activities identified. <br /> 15.The applicant shall submit a tree survey for the entire site including a <br /> valuation of all trees on site, prepared by a licensed arborist at the time of <br /> submitting for an Encroachment Permit.
