I oppose the motion and hope that we could have an accommodation <br /> tonight that would include additional mitigations such as the ones Council Member Claire <br /> has talked about, sidewalks on the south side of the Parkway, work on the cross streets, <br /> more traffic mitigations, more practical safety measures for the student population, and I <br /> am sure there are other things that more practically work. But I think 45 days from now <br /> we'll just be frustrating people even more." <br /> Vice Mayor Ruskin said, "This is a difficult decision, and I respect what my fellow <br /> Council Members think.... But, I think there is too much at stake here in many ways. I <br /> won't go into all the items, a lot has been discussed, but there is too much at stake here for <br /> me to just feel that the best thing to do, and I understand your viewpoints from looking at <br /> things in a strictly legal way, I feel that there is a need to explore further. A need to look <br /> beyond the obvious considerations, and because of that I will vote to support the <br /> moratorium." <br /> At 11:59 p.m., MIS: RUSKIN/CLAIRE TO EXTEND THE MEETING TO 12:10 P.M. <br /> Couneilman Leipzig said there was a motion on the floor and this subsequent motion <br /> - could not be voted upon until a vote was taken on the existing motion. Couneilman <br /> Claire called for the motion introducing the Ordinance establishing a Moratorium. City <br /> Attorney Sehrieker said, "Because of procedural matters, I recommend that you take the <br /> time extension first." Councilman Leipzig said, "I believe that Robert's Rules of Order <br /> will dictate that you have to vote on the motion on the floor." City Attorney Sehricker <br /> said, "That's right, but you have a procedural situation where you don't have a meeting if <br /> you don't extend it." <br /> After further discussion by several Council Members, City Attorney Sehrieker said the <br /> order of business was up to the Mayor. <br /> Couneilman Leipzig said, "In the 45-day period, I just want to say that we can look at <br /> some of these alternatives, because I agree with Councilman Hartnett that we should get <br /> more out of the developer. I don't want to cost the developer any more time or money if <br /> indeed they are moving forward. But during this 45-day period we can look at those <br /> options, in addition any conflict in the Specific Plan and the zoning.
