MOTION FAILED ON THE FOLLOWING VOTE: AYES: COUNCIL MEMBERS BUCHAN, CLAIRE, HARTNETT, IRA, RUSKIN AND MAYOR HOWARD NOES: COUNCILMAN LEIPZIG MINUTE ORDER NO. 97-223 City Attorney Sehricker said, "Madame Mayor, respectfully, in front of my, what may be my opposition in Court, I would prefer to have you remedy what I consider, maybe, a procedural defect. The rule of the house is, this Council adjourns or the meeting ceases as of a given time, unless by a unanimous vote you continue it. We have passed that time. I realize that one of the Council Members is arguing the point that we should be able to address a motion on the floor. But after you consider the debate that extends the meeting, de facto, for ten minutes beyond the period of time, my concern is that we are going to be having a procedural battle rather than a substantive battle. So I recommend that we do have, if the Council would be so willing to do this, of course if you don't want to you don't have to, but to remedy and avoid this situation, pass a motion which would extend the meeting and adopt it unanimously." - At 12:09 a.m. MIS: CLAIRE/RUSKIN TO EXTEND THE MEETING TO 12:15 A.M. Couneilman Leipzig said, "I have a question on the motion. I'm sorry I missed the first part of it. Are you moving forward because we are past 12 0' clock? You want to extend the meeting to vote on my motion, is that correct... or for further debate?" City Attorney Sehrieker said, "That's up to the Council what they will do, because whatever time you set, will stop the meeting." Mayor Howard said the City Attorney had advised it was a procedural matter and it would be prudent for the Council to extend the meeting and then vote on the introduction of the Ordinance. A short discussion ensued regarding procedure and the actual time the meeting would end. Couneilman Leipzig indicated he would not vote not to extend the meeting to 12:15 a.m., but would vote to extend the meeting just long enough to conduct a vote on the introduction of the Ordinance.
