He <br /> added further that staff could begin working on this issue, "this is going to take awhile, but <br /> in order to actually approve the placement, we need to come back to you first, and (the <br /> City Attorney) needs to look into that a little deeper." City Manager Everett said staff <br /> wanted to bring these proposed Policies to the Co-Chairs of the Neighborhood Boards, and <br /> that might delay bringing this issue back to the Council. He said staff is working on <br /> developing "criteria other than CalTrans wants for stop signs." <br /> MEMO 12/9/97 <br /> Couneil Member Buehan welcomed everyone to attend the Neighborhood Co-Chair <br /> meeting on January 22, 1998 at the Police Department, which will focus on the full <br /> panoply of proposed traffic policies. <br /> In response to questions by Viee Mayor Ruskin regarding the problems with speed humps <br /> in Fresno, Mr. Smith said, "I'm unaware of any adjudications that have found these speed <br /> humps a causal factor in an accident that caused an injury." He added that there are <br /> 1- literally thousands of these humps in the State of California right now. <br /> Several Couneil Members advised staff that the second Draft Report needed more work <br /> before they could consider it. <br /> Couneilman Leipzig asked what was the urgency in going forward with the Policy at this <br /> meeting, and couldn't specific requests be brought to the Council at the next meeting? <br /> City Attorney Sehrieker said, "The question is implementation. The question really is <br /> whether or not each speed hump installation should be brought back to you for approval as <br /> is the case with stop signs, for instance, where the Code requires that it come back to City <br /> Council. Or do you desire as a Policy matter to delegate that authority to the staff and <br /> establish particular criteria for that. That is the basic issue I am going to advise the staff <br /> on. There are ramifications regarding the immunity that I was talking about in that <br /> context. I do recommend that you adopt this resolution to the extent we are going to use <br /> speed humps in this City at all, because you do want to have the benefit of that design <br /> immunity which you shall get. But I can't tell you, and I won't tell you until we have a <br /> lawsuit on a question, is whether or not because you didn't approve the specific location of <br /> a street hump we would get the benefit of the design immunity. That's the main issue, and <br /> I just want to talk to staff some more, so they understand the legal perspective that we are <br /> looking at." <br /> I <br /> 1 Mayor Howard asked if anyone in the audience wished to speak to this issue.
